I wonder how costly (financially) any court action by Poyet would be and if unsuccessful would he have to pay the clubs costs too. This may deter him from doing so.

Common misconception. The % of cases whereby a claimant who loses such a case ends up having to pay costs of the company who defended themselves are incredibly small. Less than 1% of cases, I believe.

The LMA has issued the following statement regarding Gus Poyet, further to Brighton & Hove Albion FC failing to uphold his appeal against dismissal.

LMA chief executive Richard Bevan said, “I am really very surprised that the Club has made the decision to dispense with the services of such an outstanding football manager as Gus Poyet.

“Gus has an excellent record of success with the Club, as can be seen from the statistics set out below. We have every faith in Gus’s integrity and have been impressed with the manner in which he has conducted himself during what, for him, has been an extremely difficult period.

“We have supported Gus throughout the disciplinary process and will continue to do so as required. We do not consider that the charges against him amounted to gross misconduct. Gus will now reflect on the outcome and discuss options with the legal team. It would, therefore, not be appropriate to make any further comment at this time”.


Gus Poyet stats:
• At the time of his departure Poyet was the 6th longest serving manager in English football.
• Poyet joined Brighton in November 2009 with the Club in a relegation battle in League One - they were in the relegation zone.
• He achieved promotion and a league title in his first full season as a manager.
• He was later recognised by his peers in the division, as the managers of League One voted him as the Manager of the Year for 2011.
• In 2011/12, Poyet won the Football Managers Outstanding Managerial Achievement Award at the Football League Awards.
• He enjoyed an excellent first season in the nPower Championship, achieving a 10th place finish.
• In 2012/13, he guided Brighton to the play-offs after finishing 4th in the Championship.
• Their fourth place this year is the Club's highest finish since 1983 - ie in 30 years.

I have trouble with this statement. Whether Gus has an affinity with Brighton is something only he really knows. But you don't deliberately pick a player to lose a game, especially if you do want to move to a perceived better team. In the time of Gus, he attempted to 'play' at being a manager and IMO, did it pretty well.

Agree with the way you've put that. If you've watched the club for 40 years, it's not unreasonable to know why one of the best managers in that time has been summarily sacked. And it's not like this has happened behind closed doors. The main news is already known, it's just the club's reason.

I don't actually see why there is any legal need to keep it quiet, especially as it would benefit the club. There has been no agreed settlement, so there can't be a confidentiality clause signed yet.

It has nothing to do with confidentiality clauses. The Data Protection Act (1998) makes it an offence to release information that is covered by the act (and a person's employment record would be covered) without there being good reason. There is a public interest defence for releasing data, but that is not about telling the public because they are interested.

In the time of Gus, he attempted to 'play' at being a manager and IMO, did it pretty well.

We didn't lose that game. We fought back from 2-0 down to draw 2-2. It could even be argued that Kuszczak denied us the win with his superb saves from Vicente. That's probably why Gus bought him when Man Utd released him.

That's just plain incorrect. Under Data Protection rules, they should probably destroy his bank account details but that's about it. You are definetely allowed to announce why people have been sacked. Look in the paper today, there will be details of people being sacked

No it is not. Most of such examples will be reports from employment tribunals, which are public hearings. The others will be the sacked person going to the press. An employer cannot just release details of an employee's record.

And I would suggest that the relevant legislation and guidelines might be a better source of information on the act works, rather than the press.

How is Bevan surprised? He has been suspended and then sacked for months! Hardly a surprise, and he knows a lot more about it than we do.

I think his comments almost go beyond defending Poyet there, and verge into meddling. The stats are irrelevant. He could have won the Champions League, but IF he did something really bad, then it's a matter of principle.

And if he didn't, let's hear the defence (plus the original charges would be nice).

I know I was there. Just have trouble with anybody thinking a manager would consider sending out out a sub standard team, unless it's the League Cup of course.

Of course they should make a statement. There are two sides in this situation. Even in a court of law there is a prosecution & a defence who can make statements.

To my eye the LMA releasing the statement including his statistics are so as to not affect his future employability. As the saying goes mud sticks. A dismissal for gross misconduct never looks good on anybodies CV.

I personally reckon this will be the end of it, the LMA have as good as posted his CV on the end of a formal statement highlighting what he has done for the albion and making comments about how he has acted professionaly etc. If he took it to court, it would cast a shadow over him for other potential employers/clubs, would you hire a manager that took his last club to an employment tribunal?

Either way, thanks for all you have done but Gus' Ego had reached the ceiling. Oscar will take us to the next level.

Agreed - how the hell is the statement about us moving into a new stadium at a cost of £93million relevant?? Is Gus now claiming that he funded that out of his own kindness??!
Bevan comes across as a bit of a sycophant and surely he should be encouraging the way the club has gone about this disciplinary procedure rather than just and arbitrary sacking?

It's a strange statement that's for sure. I'm no expert, but to me it looks like he's written that up to stay onside with Poyet and almost attempt to sell him as a prospective manager, whilst deep-down believing that he is guilty of gross misconduct. I could be way off though!
