Thought VAR was supposed to spot the divers, when it does refs should book them, instead they just wave it away.

Yep.

In order to preserve the special role of the referees and their right to be the ones making the decision, which is, as everyone knows, the most important thing in football which is all about the referees (who never wanted VAR in the first place and sabotaged it with lengthy delays and that), the scope of the outcome of VAR checks has been severely restricted. VAR can check whether a penalty should have been given if it wasn't. It cannot check whether a yellow card should have been given if the ref hadn't given one. It can however check whether a straight red should have been given, had no card been given (and it wouldn't have done so here because diving is not a straight red offense).

He didn't say they make the rules, he said they make the decisions. Subjective laws are all 'in the opinion of the referee', meaning that it is the referee who makes the decision and why VAR can only advise to look again on subjective calls.
