They should do a referendum but everyone who votes in favour of the death penalty has their details recorded. For every miscarriage of justice one person who voted for the death penalty is randomly selected to have the death penalty applied to them too. Fair’s fair.

It wouldn't be appropriate to prejudge a trial before a verdict has been returned by a jury through a fair trial
