This could be the whole crux of the matter , by deflecting criticism away from the incinerator and trying to play down the JR issue (which they hope has the opposite effect) , LDC could be using "smoke and mirrors" tactics. The best case scenario for them is for the club to fold before they have to pay out on legal fees and then confirm the go ahead for the incinerator spewing carcenogenic particles all over Sussex.
