Not a great example to pick really. The whole / only argument put forward by proponents of the death penalty is that 'it would be a deterrent'.

They should do a referendum but everyone who votes in favour of the death penalty has their details recorded. For every miscarriage of justice one person who voted for the death penalty is randomly selected to have the death penalty applied to them too. Fair’s fair.
