Eu Court For Falmer Fight

Dec 27, 2005

BRIGHTO KEMP TOWN
After a conversation with a Falmer Parish Counsellor, it seems very likely that FPC intend to take the Falmer Stadium issue to the European Court after Lewes District Council have run their course with action and appeals in the High Court. It was FPC who persuaded LDC to take action in the High Court on their behalf, as they needed a "blank cheque" to cover the high costs which FPC could not afford on their own. There can be little doubt LDC and FPC are using the court processes to delay and scupper the building of the stadium by bankrupting or financially wounding BHAFC. Do not under estimate their determination! Last month Anne de Vecchy, fired LDCs' first salvo in their propaganda war in a letter to the Evening Argus (a newspaper she despises, and probably does not read) she stated that any delays to High Court Action will be down to BHA defending itself as a named defendant. There have been other subsequent statements by officials of LDC blaming the ODPM for delays aswell. As pointed out by Lord Steve Bassam the disputing of the detail of National Park boundaries is another way of holding up the action, as this would have an important bearing on the High Court Case.
It seems that FPC have been very busy writing to every environmental pressure group, lobbyists and any other interested parties asking for financial or moral support in an effort to give LDC moral credibility in their actions. I'm surprised that they havn't got SWAMPY out of retirement and living somewhere under the disputed potato field. ("AONB!")
Pressure must be put on LDC to drop their High Court action.Tax payers money is being spent on trying to bankrupt a much loved football club "OUR CLUB!" We need to renew our vigour for the fight, don't let the issue slip from the news pages, tv or the public eyes and ears.

This is seriously bad news (if true) - we could remain as nomads for years.

To be honest FPC being able to afford the EU court is taking things towards fantasy, if they lose the appeal at the high court its as good as done.

They are bigging up their options exactly as the Albion are their own. The fact they are even talking about EU court suggests they think they are going to lose.

Exactly - if they couldn't afford to take things to the High Court had LDC not got involved then how the hell would they be able to afford the European court - surely it's complete bollocks.

But if they take it to the European court, that will delay the stadium building by a huge amount and we would suffer huge losses and potentially, Falmer would not be a viable option.

It doesn't look like it. Fairly detailed personal history.

No reason to think it isn't genuine.

Their occupation sorts of explains how they got into conversation doesn't it.

I've absolutely no doubt that Falmer Parish Council would like to take this as far as they can.

Whether they can afford to do so is another matter altogether - as is the matter of whether anyone else will support them.

FPC's lawyer, Charlie Hopkins, has been to the European Court before - over the Arsenal Stadium case.

He lost.

I find it reassuring that Falmer Parish Council are already fantasising about what they will do when then lose the argument in the UK High Court.

Surely the European Court, the defenders of all things right and good, are not just the preserve of the rich?
