This is a trivial issue, but I still can't see how he's actually allowed to drive if he actually doesn't have a driving licence, which was one of his reasons for arrest ? ???

Is anyone without a driving licence allowed to drive unless they are caught and appear in court ? ???

I'm with you on this one, he is not legally allowed to drive, as by the sounds of it he shouldn't have been on the road in the first fu*%ing place!
But as Wrong-Direction said this doesn't stop scumbags like this stealing another car tomorrow sadly.

If he doesn't have a license then he is not permitted to drive unless he fulfils the requirements for a learner. If he's been disqualified then he is not allowed to drive any motor vehicle on a road or any other public place.
If he drives whilst disqualified it is much more serious than driving otherwise than in accordance with a license (whether of not the license has ever been held); there is a school of thought (to which I tend to subscribe) that a conviction for driving whist disqualified should carry an automatic prison term.

While I understand which angle you're coming at this from, I can't understand why?

What difference does it make whether he was planning on heading straight on originally or not? Either way the speed is many, many times in excess of what is acceptable and safe in that situation, so I don't quite understand what the route has to do with anything?

There's no real "why" to my angle, more a case of "how". How did that poor bloke end up getting hit.
Sure the video shows him getting clobbered by the Fiat that is clearly being driven too fast and in a dangerous manner for the environment its travelling in.
But when you look at the 5 seconds leading up to it there is a huge element of "fate" in that final split second reaction of the driver to take the left turn.
So my angle is, if the taxi had stayed put, or pulled out quicker might the collision with the pedestrian have never happened?

Our lives are full of split-second decision making and it's fortunately rare where the consequences of such decisions will have a life changing impact, as is the case with this incident, on both the victim and the perpetrator.

I guess I'm just exploring the fate element of being in the wrong place at the wrong time, aspect.

Starting point for Dangerous Driving is a custodial sentence. Aggravating factors appear to be injuries caused, excess speed, attempting to avoid detection so I'd say that pushes firmly into Crown court territory. I'd say he's looking at 6-9 months inside (if he's a first time offender and pleads guilty)
12 month disqualification and extended retest is mandatory

6-9 months really, this knob got 2 and a half for deliberately driving at a cyclist

I remember a hit and run story a few years back in Slough/Reading where a pedestrian was killed and it was all over the news. The bloke handed himself in 3 days later and said he panicked and felt guilty for what he had done. He never went down for it. Basically got away with it.

What annoys is is that you don't know if they were intoxicated at the time which would also go against them

A realistic sentence for that hit and run bloke should be no less than 5 years.

Maximum sentence is two years. He's unlikely to get that unless it goes to full trial, he has a horrendous record of previous similar offences and there are a plethora of other aggravating factors.

Absolutely, but the fate aspect may be that the taxi didn't move, he went straight ahead and the person (or people) he hit that way was not so 'lucky'.

7 years max, Dangerous driving combined with GBH.
14 years if a fatality has occurred.

Don't forget the GBH when sentencing.

My money's on 5 years.

Is there any update on how Andy Payne is?

edit. I see he has returned home. Did he not even suffer fractures to his legs, news items just suggest head injuries. He is an incredibly fortunate man to have not only survived that, but to come out of that and make a full recovery is just amazing news for him and his family.

If he's telling porkies he is also going to need his girlfriend to go along with it, won't be easy for her and you would expect her to cough when the screw is tightened.
