The game already rescheduled after The Seagulls famous penalty shoot out win of Premiership rich boys Manchester City, has been put into doubt after The Seagulls 4-1 crushing defeat of Millwall on Saturday 1st of November at the Withdean Stadium.
It will come as a shock to many fans who have forked out as much as £18 for a match ticket, that this news comes at such short notice.
An eye injury to Albion hit man, Adam Virgo has meant that The Seagulls are unable to field enough players to contest the 3rd round tie, which states each team must name a squad of eighteen players, naming seven substitutes.
Albion, already without new superstar Bradley Johnson, have injuries to Nicky Forster, Gary Hart and Kerry Mayo. This comes on top of the fact that defenders Joel Lynch and Adam Hinshelwood are also out on loan.
UEFA rule 17.2 "cannot field a team" has been called into question by Albion boss Micky Adams because Virgo plays at right back, centre back, left midfield, right midfield and striker. The ruling usually applies to teams that cannot field a team due to several International call ups, but Adams has asked solicitors to ask for special dispensation.
Manager Micky Adams said: "We think he has got a hairline fracture and we might have to get a mask made for him, which will not hurt his looks! He is definitely out tonight but not ruled out for Saturday."
If the game does get called off, Albion or Derby may have a major fixture pile up as the 4th round tie against Leeds United is due to be played on the 12th November, and could mean three fixtures in five days starting on Saturday when Virgo's protective mask arrives from the BUPA clinic.
