The Argus report is factually correct. Tommy Elphick was arrested.

But the Argus stated he was not just arrested but "accused" which is a different story. You can be arrested under suspicion of a crime without a charge ever being brought, which may be what has happened here (maybe not), but to say someone is accused of a crime means they have been charged.

So I would say this headline is very possibly inaccurate.

Seriously - I've disobeyed orders there in not issuing you a life ban. Tread carefully. No room for idle conjecture regarding the alledged incident or the complainant.

But are we allowed to query the accuracy of the Statement identifying the Accused, seeing as how quickly Tommy was cleared ???

Does anyone think that the club knew about the pending arrests before the Wrexham game, and this was the reason we were so poor and unfocused?

We always have been with non league clubs. Look at games again FC United and Woking.

They were not aware in the slightest, Gus would not stand for it at all!

They ran the headline on the back of the original Police statement.

Six men were accused and brought in for questioning. None have been charged so far. One person has been dropped from the enquiries.

I'm sure the the Argus will run an article saying he has been eliminated from the inquiry. They don't need to apologise IMHO. He was arrested, which is what they reported.

In a way. Although the headline actually states that Tommy has been ACCUSED of (a) sex assault. I don't believe that that has ever been the case and they worded it extremely badly. In fact I hope it's badly worded enough that Tommy can sue their arses off.

As I've said before being arrested and being charged are miles apart. Good for you Tommy. Must say I've been very impressed with the club so far in how they have managed the incendiary headlines.

and not just possibly, it was totally inaccurate. As far as any one knows no one has been accused, only arrested in connection with an alleged incident so the Argus exaggerated so the DO need to make a FULL apology to Tommy.

They were really awful though, they looked like a bunch of misfits playing their first match. They played as if there was a dark cloud over them, passes going astray all night, when passing is supposed to be our game.

The Argus report is factually correct. Tommy Elphick was arrested. As I posted on another thread yesterday, people can be arrested for all sorts of reasons. Being arrested does not automatically imply that you are even under suspicion for committing a crime. You can be arrested "to help the police with their enquiries". And that sometimes means EXACTLY what it says.Sometimes, there is an ADVANTAGE in being arrested. It means that you are entitled to the support of a solicitor, while the police interview you. This can be very helpful.

The problem is that the average reader of the Argus doesn't understand this. I suspect that the average journalist on the Argus doesn't understand it either. People assume that an arrest MUST mean that you are being accused of committing a crime. And then the speculation runs wild.

Even the "innocent until proved guilty" argument falls into this trap. As things stand, there is no verifiable assertion from anyone that Tommy Elphick has even been suspected of committing a crime. ALL that we know is that he was arrested, that he was co-operative, that he is no longer of interest in this enquiry, and no further action will be taken against him.

I disagree with this. A person's arrest deprives them of their liberty for questioning and further inquiries because they are suspected of involvement in a crime. I do not know of any cases where witnesses are arrested. Witnesses are questioned without being arrested.

Not if the police feel that an interview under caution, in the presence of a solicitor, might yield better information. And it sometimes does - particularly if the alternative is an interview with a nervous young man who needs support and isn't getting it.

Given how quickly Elphick was acquitted of any wrong doing it would seem the arrest dragged him into the limelight by linking his name to the incident.

There was obviously no need for his name to be dragged into this affair given how quickly he was acquitted.

His name could have been kept out of it and still helped the Police with their enquiries imo.
