To be honest so much has happened since we first started this I rarely think about it yet it is actually more important than anything else.

The club will struggle to go anywhere if this goes pear shape - still let's hope the right decision is reached.

One thing that bothers me about the decision is - will it be a straight "yes" or "no"? It may be that it has to be one or the other, but if it doesn't then I'd be quite concerned that this government would try and find a "compromise" that would end up pleasing nobody.

I'm just worried that Prescott may say "yes, but", and that the buts will include a much smaller capacity, or other restrictions that will end up hurting the club almost (but not quite as much) as staying at Withdean.

Is this a possible outcome? Or does Prescott have to give a straight "yes" or "no"?

I must admit that Duncan's scenario is the one that I am worried about as well.

Already, the Albion have bent over backwards to comply with protestors whose objective was not to co-operate with the plan to find the best solution but to obstruct the plan at every opportunity so that it would fail.

I blame the South Downs Conservation Board as being the primary obstructors and the most unreasonable organisation of the lot.
They had no genuine reason to oppose the plan other than National Park dogma.

I can understand local residents being concerned with the details, and I can even understand them wanting it to fail (not that I agree with them) but the South Downs Conservation Board to use a fallacious argument about the merits of a ploughed field, they should know better, and they are on a power binge. They are also a non-elected quango not answerable to anyone as far as I know.

Arbitary conditions seem to be a feature of some Planning Inquiries. I would not be surprised if the Falmer plan has gone miles over budget because of the Village Way North location, wheras the Village Way South location would have been cheaper because there would be no need to bribe the University.

Both locations were on the table at Hove Town Hall. This is one way that conditions have eroded the best solution. I think the Brighton Councillors have performed very shoddily over this issue.

The genuine protestors are three men (probably about twenty old bags and one pub landlord) and a dog.

I am fed up with it and to cap it all, I do not think it is even the best place for the stadium.

I think you could be right. I'd be very suprised if it was a straight 'yes'. There is almost definatly going to be certain 'conditions' imposed. What these may be are anyone's guess.

ALL planning decisions have conditions attached to them. This one will.

Looking at other ODPM decisions, we can obviously expect stuff like:-

"The development hereby permitted shall be begun before the expiration of 5 years from the date of this permission";

"No development shall commence until details of the pollution control including foul sewage disposal and surface water drainage have been submitted to and approved in writing by the Local Planning Authority; the development shall be carried out in accordance with the approved details";

"All landscaping, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation."

... etc. etc.

None of this sort of stuff need bother us.

There will also be a legally binding Section 106 agreement in place between the Club, the City Council and the two Universities, which, in effect, will create a whole range of very strict conditions. These may well be endorsed by Prescott in his decision. Prescott will also no doubt place restrictions on the parties to the Section 106 agreement agreeing future variations to it.

There will also be conditions relating to the interests of East Sussex County Council as highway authority for the Falmer - Woodingdean road.

In fact, we can expect several dozen conditions to form part of the planning permission.

When people see the thousands of words in the decision letter, there will no doubt be a deal of panic. No need for it!

A very pleasing aspect of this thread... LB saying he reckons it will be July... he seems to know his stuff, and I hope he is right...

As long as there is no condition to restrict capacity unreasonably, then it will be OK... tree planting conditions et al, I can live with...

It is so obvious to anyone with half a brain that "Yes" is the correct decision, so I am reasonably confident... just hope JP applies half of his brain to the decsion... if he does, it must surely be a big fat "Yes"...
