There's no way this should end up in 50/50 territory.

Disgruntled was already on the main road, therefore he had right of way. Someone reversing out of a parking space into the side of Disgruntleds car....you can't get a more clear-cut case of liablity than that. Even if the cabbie thought Disgruntled was letting him out, it STILL wouldn't make any difference.

Claim.

You are assuming that the taxi driver is going to come up with a similar version of events. No doubt he will come up with a completely different set of events that caused the accident. With no witnesses he can pretty much say what he likes.

My advise will always be to get the contact details of someone who saw it at the time.

Trust me this has 50/50 written all over it! It's a real sickener but there is feck all you can do when you come up against lying scum!

Well, going by what Disgruntled has described as the cabbies "defence", it sounds flimsy in the extreme. The damage to the two vehicles should tell its own tale - Disgruntles door caved in, and the cabbies rear bumper nestling in his boot.

Having said that, I take your point. You can ALWAYS rely on insurance companies to screw you over somehow.

He was RESERVING onto a MAIN ROAD?

Thats 5 penalty points for Dangerous Driving over here in the first place. I'd assume the UK is similar.

Or was this inside the carpark still, and hence in the land where road laws don't matter?

It was the Mill Road Park & Ride (public road).

But I do remember the guy saying to me that I obviously wasn't a regular P&R user, because there is some etiquette in letting cars out and giving people space (must also include when you're alongside them?). When I told him I'd been using the same P&R for something like 4/5 years as a STH, he said he'd been an STH for 30 years

I guess I derversed to get hit - only a STH for 5 years, sent off for my ticket 2 days after it was advertised from Southampton, and got one!

And taxi drivers are the worst for it I'm afraid - the always get together in situations like this. His witnesses are probably taxi drivers from the same or sister firm...
