My understanding is this:-

Rather like a Judicial Review, the powers of the full Council are to refer the matter back to the Cabinet Committee and ask them to reconsider their decision.

The Cabinet then has the power to ignore the full Council. But it does so at its peril, since the full Council has the power to dismiss the Cabinet.

That's how things work under Lewes District Council's constitution. [Brighton & Hove Council has a quite different constitution, by the way, so don't draw general conclusions about all local government from this response].

A quite separate issue from the decision of the Cabinet to go ahead with the application for Judicial Review is how to fund the legal costs that will be incurred. If the costs are significant, the full Council must be involved in any decision as to where the money is to come from. But that question only arises when it is certain that the costs ARE significant. So they don't have to take any decision right now, but only when the bills start rolling in. If Lewes lose the case, the biggest bill will be to meet the legal costs of the government - which are likely to be massive.

If costs are awarded against Lewes DC, they will basically have three options:- dip into their reserves (leaving it to a future year to top up those reserves); OR increase Council Tax; OR cut other services to provide the funds.

The point at the moment is that they are taking a huge gamble that they won't lose. If they do, then they are in deep doodoo.

It's the irresponsibility of this reckless risk taking that we need to be campaigning against.

Again, this is my understanding of what will happen at the very first stage:-

Lewes DC will apply to a High Court judge for a hearing. LDC will say "We have evidence that Prescott's decision is flawed". The judge will say "Best I hear it then". The judge will then fix a date for a full hearing of the case. Lewes won't have to produce their detailed evidence at this first stage.

The ODPM need say nothing at this stage. They will wait until Lewes DC produce all their evidence, and then produce their response to it.

Theoretically, the judge could respond at the first stage by saying "don't be ridiculous". But this is only likely to happen if the Lewes lawyer is so drunk as to fail to get his basic point across. It is very rare for that to happen.
 




The worst case scenario is that, after the full hearing, Lewes DC end up winning the argument.

In that case, the judge will simply pronounce that the decision was flawed and refer the planning application back to Prescott, with an instruction that he deals with whatever flaw has been found.

Prescott can still give the Albion planning permission, provided the flaw in the process is dealt with.

I was down in Sussex helping my Mum and Dad move over the weekend between houses in Ringmer. Didn't get to the match but heard the news. My Mum is extremely pissed off about the waste of taxpayers money and will be firing letters off to her three Councillors.

But is there any point her writing to this guy if he is suspended?

(and what was he suspended for, anything juicy?)

I can now answer my own question:-

A Tory councillor has launched a High Court bid to clear his name after he was suspended for sending damaging emails.

Councillor Ian Wilson sent a series of emails questioning the competence of a planning chief and his staff.

He was suspended for a year from Lewes District Council on the recommendation of the Adjudication Panel for England.

The panel, sitting as a three- member tribunal, ruled one email was a personal attack on the "professionalism, honesty and competence" of Lindsay Frost, the council's planning director.

Others were said to be "disrespectful" and "damaging" to officers in the planning department.


He sounds like he could be an ally!!!!

What that seems to be saying to me is "Don't balme me for this" - in other words perhaps some of the other Councillors, not in cabinet are not happy about this.

If all councillors therefore, not just those in cabinet are bombarded with emails etc then maybe there will be enough of them speak up at the 7th of December Council meeting to get the threat of a JR withdrawn.

Get typing those of you in the LDC area!

He is one of three district councillors representing the Ouse Valley and Ringmer ward. The other two are Andrew Small and John Fletcher.

Contact one or both of those two.

I live in that ward. Andrew Small and John Fletcher both seem to have a higher profile than Ian Wilson.

As the earlier post suggests, he was suspended for saying inappropriate things about the District Planning Officer, Lindsay Frost.

Something that, I am sure, no-one on NSC would consider doing.

I think this is the best policy to bombard both the cabinet & the other councillors. There are only 4 Independents, I believe but the rest of the Tories & Lib Dem not on the cabinet may have different views.

It is a interesting that the LDc Tories as the 'opposition' did not take a differing view as their Lib Dem colleagues, so it is likely that most of them will vote in support of cabinet, I guess.

If they all receive letters, calls, e mails they may take on board our arguments particularly around forseeable hike in council tax.

I guess if we take an aggressive stance either face to face or make threats although justified, this will only enforce their stereotype views on football fans & if I was them would be even more intransient.

Therefore I believe it is important to be polite & state the concerns using facts rather than abuse if we want to effect a U turn on LDC decision.

(And by the way let's not waste our time with Baker as he has little or no influence on this & certainly not with those Tory councillors!)

Lord Bracknell's advice on the other LDC sticky re people sending an e-mail to their Lewes District Councillor, & copying it to the officers of the District Council who are dealing with this issue is very sound indeed.

In my past experience with Adur Dictrict Council a lot of advice & guidance on decisions particularly involving legal & planning issues are provided by the Chief Executive, District Solicitor & Planning Director.

This does not mean that they make the decisions, far from it but clearly if such advice was that it would not be in the council's interest to pursue a particular line, councillors would be hard pushed to disagree with such advice.

So it is important that the following are copied in, letters written & e mailed too:
