The way it is all worded, it talks about 'a UEFA club competition' - not 'the specific UEFA club competition'. And reading 5.02a - it says that the club that stays in is the club which qualifies on merit for the most prestigious competition.

Now, if it were the case that Palace would simply be shifted to the Conference, the clause would be otiose - because if two clubs owned by the same person qualified for, and were allowed to compete in, two different competitions - there would be absolutely no purpose for 5.02a. It strikes me that if they decide Palace cannot compete in the Europa, I don't think they'd be able to compete in the Conference either.

Which seems to imply the opposite. That, 'exceptionally' a club may be shifted down the competitions. So, in that case - it could well be the case that Palace get shifted into the conference and take precedence over Brondby by virtue of 'qualifying' for a more prestigious competition.

I don't think it is unclear because you need to consider the two instances of multi club ownership. First of Textor and Lyon and then Blitzer and Brondby. In both cases, ie Lyon and Brondby, finished higher in their respective leagues.

It affects us too, as we may be looking to sign players that may only come if there's guarantee of European football..... They'll be waiting until this is all sorted out.

What I believe the following is saying that if there are two clubs that meet the criteria of dual ownership they can't compete in 'a' Uefa competition and the one that qualifies for the better competition takes precedence. I think that suggests that Palace would still have had problems even if Lyon had qualified for the Champions League because you can have a situation where, following the league phase, clubs from the CL drop down to the Europa League and the chance of a conflict of interest can then arise.


If two or more clubs fail to meet the criteria aimed at ensuring the integrity of the competition, only one of them may be admitted to a UEFA club competition, in accordance with the following criteria (applicable in descending order) with the exception of the scenarios set out in Paragraph 5.04 and Paragraph 5.05:

That would be daft. Our recruitment strategy and dept are not daft.

Anyone only signing for a club the size of ours (or Palace) based on Europe would be the type of player we would want to avoid anyway. Ambitions of Europe = Yes, Guarantee of Europe = No.

Clubs no longer drop from Champions League into Europa League and Europa to Conference at the end of the new league phase.

They do drop through the competitions in the qualifying rounds tho so those rules still apply but it may be different if all teams enter directly into different league phases as they cannot meet at any stage of the European season.

I think the complication here comes that it could be argued that Palace haven’t met the qualification criteria for the Europa League, so moving them into the Conference League would mean the merit of league position still applies.

Yes - that was the first half of my initial post. It seems to imply that you simply can't have two clubs in any of the competitions. But it then (5.04) goes on to say 'exceptionally' a club kicked out of one competition could still enter a lower competition.

Which brings into the equation the discussion about the Palace / Brondby relationship - which is the bit we were discussing here. If Palace are 'exceptionally' kicked out of EL and demoted to Conference - then they are, under a literal translation of the clauses, above Brondby in the pecking order as they qualified on sporting merit for the EL.
