BRIGHTON AND HOVE LOCAL PLAN – INSPECTOR’S REPORT

Thank you for your recent letter to the Deputy Prime Minister, concerning the Inspector's recommendations relating to the Brighton and Hove Local Plan and the proposed community stadium.

I should explain that, although the Inspector is appointed by the First Secretary of State, the inquiry is held on behalf of Brighton and Hove Council. Because of this, it is not normal practice for the Planning Inspectorate to comment on correspondence once an inquiry has ended and the resulting report has been sent to the local planning authority. Any correspondence relating to the inquiry is a matter for the local planning authority, since under current legislation responsibility for subsequent action rests solely with them. We are also unable to seek comments from the Inspector, as once an inquiry has formally closed the Inspector cannot comment on further correspondence.

In the circumstances, you may wish to bring the points made in your letter to the attention of Brighton and Hove Council, asking that they take them into account in considering the Inspector’s report and recommendations. I am forwarding your letter to the Council accordingly.

Basically, the next action as a result of this report is down to the Council, who would be minded to ingore the recommendation the Falmer is unsuitable should Prescott say Yes. It's a bit irrelevant, however, if Prescott says No.

Can anyone explain this sentence from the planning inspectorate letter ? Where does JP fit into this then ?
Is the decision down to B&H Council or 2 Jags ?

The decision is down to John Prescott. The council have already given planning permission by 11 votes to 1.

This inspector did his report for the local council so basically his report is criticising their policies, which also happen to be the policies of the Government.

If Prescott says no then that is it. Finished. Overuled the council.

If he says yes then it agrees with the council decision.

Remember - we were writing to John Prescott about Mr Hoile's report on the Local Plan Inquiry.

That report was submitted to the City Council, not to John Prescott. They must consider the Hoile Report and decide whether or not to accept its recommendations.

To that extent, it is indeed the case that "responsibility for subsequent action rests solely" with the City Council.

However ... the point of writing to John Prescott was to seek an assurance from him that he would not take into account the incorrect conclusions in Mr Hoile's report when he comes to consider the other report on the planning application - which was submitted to Mr Prescott by Mr Collyer.

Responsibility for responding to Mr Collyer's report lies with John Prescott.

What seems to have happened is that the Office of the Deputy Prime Minister have passed the correspondence on to the Planning Inspectorate for them to reply to.

Nothing to worry about in this. The Campaign is having the impact that we are looking for. They are having to deal with shed loads of correspondence.

On NSC for over two decades...
Quite right Lord B, it is demonstrating to the ODPM that the Falmer application is important that is the main issue, not whether or not Hoile's report is dealt with by them.
