This clown has now paid me all the money he owed including all court costs and all my solicitors fees.

I must say the process which we followed gives me some faith in the British legal system. Whilst the process is very methodical and therefore slow it is cheap and did allow us to prove his guilt and then pursue him and then his employers for what was ours.

Through this website another person in the similar situation got in touch and was able to follow our process and has now also been paid in full. Hats off to NSC.

I have had contact with two independent estate agents in Brighton. One did a bunk with the company's profits shortly after I bought my house from him. The other is Tony Carter.

I play cricket with a guy who works for the Law Society investigating dodgy lawyers. It's incredible (or maybe not) how many lawyers pilfer from their client accounts and then get themselves into massive strife by continuing to dip into the client's money.

The end result is inevitably that some poor bastard's mortgage isn't paid off when they complete a house sale.

the Law Society do step in and cover the costs, but only after months of investigations. What a very horrible prospect and with the credit crunch I would expect even more lawyers to be caught out (they rely on a steady stream of deposits and sale proceeds to cover the theft).

My chum tells me that if you're selling your home, it's worth checking out your lawyer/conveyancer with the Law Society first.

Now the dust has settled and I can be a little more objective I dont believe he is an inherently bad person......just a lousy businessman who's business ran away from him.

I get the impression that when the housing market was booming his business ran itself. When things got a bit stickier and the revenue streams were a little harder to come by he didnt have a clue. His juggling of being a pilot and running an estate agency then stretched him too far. He has apologised and I'm willing to accept this.

I know you've gone through a lot of shit but Tony Carter has paid up in full including costs and apologised and he has not had a chance of redress on this site so it might be gracious to let it go and stop destroying the bloke and his reputation, my opinion.

I think I have been fair. Nothing I have said is untruthful. Further, this follow-up states he has done the decent thing and paid in full and I have even said I dont think he is a bad person.

A mortgage broker (I think I'm correct in saying?) leaping to the defence of an estate agent!!

Quelle suprise!!!

er, quite the opposite, I am very critical of estate agents many times but this is balancing the ruination of a man's business and reputation

Very true; the lawyer dealing with my dad's estate, waltzed off with the money (as it was only £12k, he wasn't going to get rich on that). He did, however, get rich on the £500k of other clients' money that he half-inched.

What astounded me was that he didn't go to prison for it. If some herbert from Whitehawk or Moulsecoomb had it away with a couple of thousand quid, they'd be looking at a stretch inside, yet this bloke trousers half a million and doesn't even get prosecuted as it was felt that being struck off was punishment enough.

But my solicitor who does my conveyancing tells me that he has pay a huge amount to the Law Society every month to cover the cost of dodgy lawyers, so it must be pretty widespread.

Hold on. I think you will find Mr Carter ruined his own business and his own reputation. It's a strange society (or country eh?) we live in where people defend the perpetrator and criticise the victim. Or is this the old boys network at play? After all you are in the same industry.

..and before you suggest he should be able to come on here and defend himself there is nothing to defend. Everything I have said is fact (other than my observations about him as person...) and can be backed up by public court papers and judgements. He cannot say it didnt happen because it did.

Since when was an estate agents and a mortgage broker the same industry ?.

Not for about 4 years. I was his broker for about a year before an amicable split. I just feel the pay off and apology was enough and did not warrant another thread slagging him off and would have felt the same if it were about a milk man or whatever.
