Great estate agent story

Heard this from a friend:

He has recently sold his house and put an offer in on another house. He offered 350 on an asking price of 400, which was accepted. A few days later someone else offered 375 and the estate agent phoned him and told him he was going to recommend the other offer but my friend made the point that he had already had his offer accepted and had no chain whereas the other offer was a chain of 3.

The estate agent was having none of it so my friend said "well if that's what you're going to do then fine but if that other offer falls through I don't want you phoning me, I won't be interested. Are you sure you're going to recommend the other offer?". The estate agent refused to back down and my friend lost out on the house.

Anyway, two weeks later the estate agent rings saying the other offer's fallen through. So my friend, who by now has had to find another place and really hates estate agents, says "Look, I told you not to phone me, I really don't care that the offer's fallen through and you've been trying to sell the house for 18 months. Do you know what? You can stuff it up your arse and I never want to hear from your firm again".

Slimely bastards the lot of them!

To be fair estate agents I have met have been very fair and decent.

It is like calling all football fans thugs. Badly behaved fans make good stories. You don't hear about how well behaved the fans were last night. Goes without saying.

I'm not trying to stick up for estate agents but shouldn't your mate be more annoyed with the vendors who reneged on an agreed price.

I might be wrong but I think that estate agents have a legal duty to inform the sellers of any offer that's been made. If the sellers want to be greedy bastards then that's their lookout.

I don't blame your mate for being pissed off though.

You are right, to be fair. However in this case, the estate agent "recommended" the other sale despite knowing full well that a deal had already been agreed. So I think it's fair to say that the estate agents were being greedy twats for the sake of a few extra pounds on their part.

Undoubtedly the decision is made by the vendor but the point here is the estate agent recommended to his client that he should accept it.

That's true and the estate agent didn't behave well.

But unless the agent held a gun to the vendor's head (and that's an approach that they might just try) there was no reason for the vendor to follow that recommendation.

To my mind part of the point here is that my friend discussed with the estate agent that as he was no chain there was no risk of him pulling out, which must be the bain of most estate agent's lives. And when the agent still said he was going to "recommend" the other offer he said "fine, don't phone me if it falls through, i won't be interested".

If the agent had any morals, he could have a) appealed to the vendor's better nature or b) scared the vendor into the original offer by frightening him with stories of dodgy chains.

He chose neither, go figure...

I see a parallel here with LDC and their JR. They asked the lawyer's advice and he recommended to pursue action. LDC didn't have to follow his advice, they could have weighed up the financial implications of following that course of action and decided to take further legal steps...but they didn't.

Consequently our ire is directed at LDC not the lawyer. It was their decision just as it was the vendor's decision to look at another offer rather than your mate's. And they're the ones who shoulder the blame for the deal falling through.

had the same thing doen to me. The estate agent was scum. Anyway he kept calling and mailing me and i refused to use their estate agents out of principle.

Scum :angry:

Got justice but ending with a much better place, just hope it goes through now. :angel:

Just a minute.

The vendor was hoping for £400K and your friend put in a derisary offer of £350. After this, no vendor would feel any conscience in changing to an offer of £375.

Could you afford to throw away £25K?

It didn't work out for the vendor but thats the chance you take.

The Estate Agent is working for the vendor not your mate.
