On the other hand, you'd probably think dumping a dead horse on a main throroughfare was a good idea if it was actually part of American culture.

State Law in Idaho has special provisions for dead horses on the highway.

Summary of Opinion

Plaintiff Munns was seriously injured when the vehicle he was driving collided with a dead horse on the highway. The horse was killed when it was struck by a truck owned by the defendant Swift Transportation. In the trial, the court instructed the jury that if the leaving the scene of an accident statute was violated when the Swift driver reported the accident but did not remove the dead horse from the road, that constituted negligence. The jury awarded damages to plaintiff.

In this opinion, the Idaho Supreme Court disagrees with the trial court’s decision to tell the jury about the leaving the scene of an accident statute because that statute does not apply to a vehicle/horse collision.
