My brother works for a well known fast food chain. My brother has learning difficulties and was offered a job, four hours a day to help him gain experience, which is very much appreciated.

However 3 weeks ago the restaurant had to close for the day due to building works across the road. However my brother was not paid for the time it was closed.

I personally don't think this is correct, at the end of the day it was not my brothers fault the restaurant had to close for the day.

Opinions on this please?

As others have said the issue is the nature of the contract.

Is he employed as a casual worker which means he is on a zero hours contract and only gets paid for hours actually worked or is he on a part-time contract for a fixed number of hours?

If it is the first situation (casual) then he is not legally entitled to payment. If it is the second case then my HR Manager view would be that he is entitled to be paid for whatever his contracted hours are.

I will take a look at his contract. I have never heard of anything like this before.

I don't want to create a scene about it, because it was very difficult to get this supported work placement for him, however what they have done is completely wrong in my eyes.

My feeling is that even if he's casual, if he turned up on time and had not been informed a reasonable time in advance that his shift was cancelled he should get paid.

From the fast food chain's perspective he didn't work that day so why should they pay him. What they should have done is offered to bring him in on one of his days off to make up the hours.

Not sure what the problem is here to be honest. I worked in McD's when I was a student, and got paid for the hours I did. The workers know that's the deal when they sign up.

In fact, this restaurant have kindly given your brother a job when others wouldn't. I'm sure he more than does his job, but it would have been easier for them to hire someone else - they didn't. And now you expect him to be paid when he isn't working... sounds massively ungrateful to me.

If they were to pay him, then all his colleagues would be pissed off as they wouldn't get paid. That marks him out as getting special treatment, which will cause resentment in your brothers direction.

Don't let that get in the way of a bit of NSC fun though

I used to date a Colombian girl who got a job in McD's. They were ****'s and would not let her take a break when working a full day. I had to go and have a word with the manager. She was a lovely girl and they exploited her.
