    I think this could be a case of she thinks he's guilty as she can't remember what happened due to alcohol. He thinks he's innocent as she seemed to consent. Stalemate. Just a guess as can't remember all the details of the case.

    Very true. Reminds me of a story I posted on here a few weeks back of a girl I worked with who told me off for saying 'Jesus' (obviously no offence was meant & I even apologised...)     Ok so say someone gets convicted of rape when they were very intoxicated & they thought the other person was consenting but the other person either wasn't or the court deemed the accused of not having consent is the same as someone who plans a rape down a dark lane, stalks their victim for weeks...
