The club can ban anyone from their premises for any reason at any time. They don't need any kind of legal ruling to be able to do that.

No you're wrong. No such privacy laws exist in the UK for pictures taken by private individuals of other persons. Do the same in Germany and yes, you could be in strife for posting a persons picture on social media without their permission. France has similar privacy laws. Exceptions might be where you have taken a picture of a crowd scene or a historic building where you could obviously catch other members of the public.

I agree entirely with the expressed sentiment, and feel sorry for the poor fan subjected to such awful primitive behaviour by others alleging to be Albion fans....... but playing devils advocate, Unfortunately it may be hard for the club to prosecute even if they did find the accused bloke, unless he admits it was him.
If he denies it, or claims mistaken identity, without CCTV that may be harder.
I hope the club contact Marseille and ask for CCTV footage (before it may be deleted or overwritten).
At the very least you'd hope this individual is prevented from travelling abroad to watch Albion.
Thats a privilege, not a right, that the 99+% of fans won't abuse or cross such lines.

Sounds like hard work too, some of these modern phones are massive. Not sure it would work with one of the flip phones, I can see it folding mid insertion.
This gives another meaning to the term ring tone.
If that wasn’t legal there would be no paparazzi photos of celebrities.
Edit: and they have only just made a law to make up skirting illegal.

At least the near-universal sense of disgust I’m seeing here should be some consolation. I don’t like these generalisations made based on small samples. I’ve lived all over the place and without doubt Brighton fans are among the most benign. Which is why this sort of incident provokes such outrage. The exception that proves the rule etc.

What a horrible incident to tarnish a near perfect day on the field for this poor man and those with him. No justification whatsoever. The perpetrator sounds a horrible nasty thug who needs banning. If nobody at the club can identify this individual initially, given the apparent clear pictures, somebody will 100% know this person. As others have said, I feel sorry for the son who was clearly distressed by the incident. The boy obviously has more sense than his father.

Pretty disgusting. For a variety of reasons one punch can kill. That’s not just if it lands on a particular part of the head but also if the victim is on blood thinners. Hopefully this character won’t be watching the Albion anymore.

I would imagine most if not all photos taken in public places do not come with consent. Same goes for those on social media and pretty much all filming for news programmes.

They don't need to prosecute, they have the right to ban him from the ground if they believe they have enough evidence. They may well be seeking CCTV footage from Marseille.
