I need some help with a situation so I've turned to fountain of knowledge that is NSC...

Here's the issue. Yesterday myself and a few friends were sat in First Class on a train from Brighton to London Bridge. We weren’t sat their for long, about ten minutes at most. The reason we had sat there was because the train was quite busy and we wanted seats where the four of us could sit together, seeing as how First Class looked like the only viable option to do this we sat there (although as far as First Class goes it was f***ing pitiful). As I said we were sat their for about ten minutes before being approached by ticket-men/woman/whatever they're called (in this case power-whore scum), who asked to see our tickets, grabbed them, then told us we'd be getting a £46 (yes forty-f***ing-six pounds) fine. We explained that we had only been sat their for a short time and offered to move immediately while being generally apologetic. The main prick of the 3 wouldn't listen, however, and asserted his authority over us in a painstakingly cringe worthy fashion that matched his disgusting little moustache and just about summed up his pathetic excuse for a life.

Luckily he left to deal with something else and his colleague was a little more understanding and explained the fine would actually be £24. This is of course is better than the aforementioned £46 but still seems utterly ridiculous considering we were sat there for such a petty amount of time and under reasonable circumstances; add to this the fact it was barely any different from the standard seating and that there was no one else in their, I and my friends feel we have enough in our favour to appeal against the decision.

Are there any experts on this sort of thing or someone who has been in a similar situation and appealed? If so please offer your advice.

I assume they took your details?

Did they offer to let you pay to upgrade your tickets? The time you were there is immaterial unfortunately, the fact is that you were there. I would appeal in that the train was clearly full, you were feeling unwell, and you could not find a guard to help you, so your friends took to the nearest seating. You of course tried to explain to the collector but he intimidated and threatened you, leaving you feeling worse than before.

Are you black?

Sometimes they do all of that at the time to seem big and powerful. Hopefully you wont hear from them about it, i'm sure they have better things to be doing anyway. Things like this usually depend on what the guard is like, you sound as though you got pretty unlucky with this bloke. He may not go through with it though.

It happened to be the same bloke who caught out one of our mates on the way to Millwall last season on an U16 ticket :- he's a right jobsworth. So he will be going through with it.

Really depends what happened and as stated was your name and address taken ? If so and verified you will receive a fine however you can appeal though not sure of success rates.

The fact the train was busy or not is irrelevant the fact is unless the train is de-classified by the guard you have to pay more to travel first class and you were sitting there so you broke the rules. If you observe the signage it is all very clear.

The £24 is double the upgrade I think and we had to give real details as they phoned up to check them somehow, which is a ridiculous invasion of privacy!

I think we should say the train was full, two of us had swine flu and didn't want to spread it and when we said we'd move the guy threatened and assaulted us.

I can't stand fair dodging, although I guess this would (theoretically count as such) but I do understand where you are coming from with this.

I used to take the train to work and back from Hove to Chichester. On the journey back they were rammed solid with commuters and school kids. Various commuters would stand in the 1st Class section and others would sit. I don't see the difference between standing in the cordoned off area as opposed to sitting.

I have never EVER seen anyone given a fine for sitting in 1st Class and I have been commuting by train for the past four years. I would imagine that you were easy targets, being four young gents.

If I were you, I would write to the rail company and plead clemency. You haven't got anything to lose.

Why is checking up you are telling the truth an invasion of privacy when you have committed an offence under Railway Bye-Law ?

By saying you had swine flu could be easily checked through medical recirds so another porky being told.

Take it on the chin, you got caught in first class simple as that.

Exactly what my Ma' said. If it'd been four 40 year old blokes, he would have just told them to sit in 'standard class' FACT.

Well in that case there is very little you can do about it, its a shame but there are lots of these power hungry blokes around, especially on the trains. I had an awful one a few years ago. I was only about 14 at the time, and travelling with my older brother, i had a child ticket, as that is obviously what i was classed as. The guard wasn't having any of it and even made the police meet with us to sort it out. He took all my details, and kept asking for ID. All i had was a bus ID which says on it that it expires after your 16th birthday and he just wouldnt believe me. Ended up showing it to someone else who just said that was fine and to get back on the train :tantrum:

Sorry to tell you this, but in case you hadn't realised it, asking to see your tickets is the job he / she is paid to do, as is collecting the excess fares. Pay up, you're banged to rights, and buy a first class ticket next time you want to travel first class!
Of course, this should be done politely, but even if they're rude about it, it doesn't make any difference to your case I'm afraid.

I don't think its right that a company can ring someone up and check my name, dob, address, parents names etc.

It might be Railway ByLaw, but aren't the train companies expected to provide one with a decent service? Why is it that these gravy train franchises see fit to cattle herd people into their trains and raise prices willy-nilly?

I really do not see the problem here. They had paid for their travels and they were sitting in 1st class due to lack of other seats. I am sure they would have moved if First Class Passengers were to board the train or is it good business to have the standard class heaving, whilst having 1/4 of the carriage empty?

It is not as if this was a commuter train and people have been paying £4k+ and deprived of their 1st class seat. It is a weekend service and I believe that rules should be relaxed.

Our rail service is a joke in this country. Far too many desk bodies creaming off a bit of cash from the average commuter.

I lost my ticket on the train from London to Brighton a while back. I had a travel card that takes me up to Zone 6. I was issued with a fine at Brighton Station. Why would I have honestly said where I had come from (Zone 6/East Croydon), if it were going to cost me more than saying somewhere like Haywards Heath? I got a £29 fine instead of £20 for being honest. If I really wanted to fare dodge, then I would have jumped off at Preston Park as no-one is ever collecting tickets. GRRRRRRR.

Cheers for the advice so far.

Any chance we could appeal citing the ticket-man was probably bullied as a young child, beaten up by a tramp for his clothes, failed at school and thus craves power to mask his enormous failure of a life utilising his much-needed power to make himself feel important because he has nothing else going for him in the pathetic profession that is a dip-shit who goes around processing tickets through his little gadget for 'offences' that are criminal in the tiniest sense of the word?
