The judge said they can “expect a custodial sentence”, which I feel is quite right. And the maximum sentence is ten years. I didn’t catch if either offender has previous, but taking into account the following;

- no guilty plea, and a frankly ridiculous pair of defences in the face of overwhelming evidence (video taken by offenders phone, at the site, of a tree being felled, piece of wood from a tree in car boot, mobile phones tracked to the exact location of the tree on the day and at the time of the crime, one perp grassing on the other several times)

- related to the above, the police resources used on this and that of a fairly lengthy trial for a non-violent crime

- the national interest in the case

- the lack of apology or remorse, or acknowledgement of guilt

Will all factor into the judge’s decision, along of course with the pre-sentence reports.


My prediction is 18 months custodial apiece, minus time served, and released on license after 9 (or earlier, under the early release scheme).

Which I feel would be about right.

I agree 100%, but is 'locking them up and throwing away the key' the right response? They're not a danger to the public, indeed quite the opposite. Given the state of overcrowding in our prisons I'm not in favour of locking two more people up just for a bit of criminal damage.

But of course calling it 'just a bit of criminal damage' doesn't begin to reflect the impact and the sadness the event has brought. If 'for a laugh' they'd cut down an anonymous tree in a local park and it had done £1000 quid's worth of damage to an old wall it would have been a local news story at best. But this was no ordinary tree and no ordinary wall. As someone else has said, it's the equivalent of destroying the Mona Lisa as opposed to ripping up an old picture you did at school.

So I'm honestly torn. I don't particularly want to see them locked up (unless it's for their own protection), but on the other hand I don't want to see them get off with what might be deemed a 'typical' punishment for cutting down a tree and damaging a wall, i.e. a paltry fine and a few hours community service.

Not sure how anybody can say they're not a danger to the public.

If people like this walk free, there's a chance they might breed and create a new genus of uber-moron who will replace us on the planet and destroy the world (even more so than we already are).

The future of the human race depends on keeping these people locked up and out of the general population.

I'm not sure about prison, they didn't hurt anyone, but it was very destructive.
