We're on the home circuit now. From desperation a few months ago, things are REALLY looking good. On the strength of the evidence, Prescott can only say yes......can't he? ???

I'm not sure why lighting should be an issue.

Last night, I drove over Ditchling Beacon on my way to the game and my daughter asked if the bright lights over to the left were the stadium.

The lights in question were coming from the University area (I presume the sports pitches to the rear) and I can't see how a stadium would produce more light pollution than, therefore, already exists in that location.

I'm really starting to think we're home and dry now.

Please tell me that there is nobody left who hasn't written to JP.

Well done to all the Board and legal tem. I did notic that it did not recive a mention on the 10.30 South Tday bulliten.

There were letters at the gound last night, which were being fowarded to JP, hopefully there may be a few at the club shop in the next couple of days.

It ain't over 'till its over.....................

I have a Falmer question that someone (Lord B?) might know the answer to: if Prezza says "yes" are there any further options available to the protesters?

For example, could they seek a judicial review or appeal to a European court over Human Rights legislation? Or is it a case that if (when?) we get the decision, then that's it and it's just the smaller matter of 40-odd million to raise?

A European Court appeal is always possible, but must be on the grounds that the processes that have been followed are in breach of European Law. That is extremely unlikely. It's been a feature of the Public Inquiry that the Inspector has been meticulous in his efforts to ensure that all points of view have been fully heard.

The European Court of Human Rights, however, is another place.

As far as the Arsenal "Old Farts" are concerned, it is noteworthy that the lawyer who has been acting for the Islington Stadium Communities Alliance (ISCA) is Charlie Hopkins, who also represents Falmer Parish Council at the Albion Public Inquiry. ISCA are trying to take the Arsenal case to the European Court of Human Rights, alleging that the decision to grant planning permission for the new Arsenal Stadium has been rollercoastered over the residents.

BUT... There has been no Public Inquiry into the Arsenal application. Islington Council was 'minded to approve' the applications on 10 December 2001, and then the plans were submitted to the Mayor of London and the Secretary of State to make final decisions. Mayor Ken Livingstone gave his approval to the plans on 9 January 2002, and on 20 February 2002 the Secretary of State decided NOT to order a Public Inquiry.

It's the "NO PUBLIC INQUIRY" decision that is being challenged at the Human Rights Court, together with an allegation that information was withheld from the decision makers. That case is irrelevant to Falmer.

Just to add to that...

It was clear from this morning's session at the Inquiry that Jonathan Clay, the Albion's QC, is aware of the Islington case - as is the Inspector.

They both spent a lot of time ensuring that all the parties present, particularly the objectors, were satisfied that all relevant information had been made available to everyone at the right time.

I guess that this is to prevent a repeat of the Islington appeal (where one of the grounds for appeal is that Islington Council and the Mayor of London did not have adequate information about the Arsenal application at the time they took their decisions - thereby infringing the human rights of local residents who are entitled to be properly represented by their Council and their Mayor).

So in a way, though its been a frustrating hold-up, the Public Enquiry looks to have been a good thing for us since the whole process has been performed within the excepted standards leaving little cause for complaints from any objectors, who could've gone the ISCA route if no Public Enquiry was held.

I was just thinking that Grizz. Although I groaned when I heard there would be a Public Enquiry I now believe it was a price worth paying. If this country has any pretentions of being a Democracy as opposed to just being a place where a tiny elite can dictate to the rest of us then Prescott's decision should be a formality.

However I'm still apprehensive, I'm not sure what trick the scum can pull out of the bag to scupper it but I'm sure their evil little minds are working on it.

What a fcuking great job MP, DK and all the team have done and are continuing to do. We haven't done too badly ourselves either.

Is anyone on here a Labour party member? Petitions are all very well but having some internal party pressure is worth hundreds of signatures. If we got together maybe we could pull a few strings in the ODPM.
I am an Albion-supporting Labour member and would like to help the case for Falmer. I also work in property (a colleague is currently writing a book on planning gain), anyway she's a residential planning specialist and would be a good source of info (though she's not an Albion fan). So I have a few resources that campaigners might want to use. What can I do to help?
Don't go to many games to be honest, as I live & work in London, but will be at Brentford in the home end, as I know a few Bees fans.

Is seriously AMAZINGLY GOOD NEWS this, Thanks to Perry & Knight & everyone helping out with this, suddenly the light at the end of the tunnel is getting brighter.
