Asda Car Park Fine (Brighton Marina)... Any Tips?

I didn't realise the multi-story was 4 hours only. When did this happen or has it always been like this and I have just been lucky?

I know, should have read the signs etc

i have got a £40 fine for parking at the Asda car park (right by the cinema walk through tunnel) for 3hrs 55mins

took the kids to see a film + pizza hut on the very wet bank holiday monday

any tips how to wriggle out of paying ?


or just suck it up

Had these in the past just bin them,after a while they just give up.

I havent read the whole thread but am sure Westdene Seagull or Lady Seagull will have put you on the right course of action. 1st and foremost although they like to call it so it is not a Parking Charge Notice but an invoice inviting you to pay. YOU WILL NOT HAVE TO PAY IT AT THE END OF THE DAY. 1st Go to pepipoo and use their template letter to write to the company. 2nd if they dont cancel it appeal to POPLA who WILL uphold it because their is no financial loss to the car park land owners as it is a free car park. If by any remote but unlikely chance the company find a loophole to win the appeal the outcome is binding on the company irrespective but not on the driver, so they would still have to take you to County Court and there are so many precedant cases that they have no chance whatsoever of winning there. These companies make their money through intimidation and fear put into people that they may be legal and of the subsequent consequences. They have no legal standing whatsoever and if correctly opposed will always lose.

I had a 'ticket' cancelled that was issued at Asda Hollingbury despite the attendant telling me the car park was owned by Brighton Council and he was an Ex Police Sergeant, who knew what he was talking about. It never reached appeal stage and was sorted by the peipoo template letter.

Has anyone ever claimed that a £70 council ticket is too expensive and won then? Great example of how a guy claimed and won on the POPLA site.

Errrrr ....... POPLA is for private tickets only not council ones. And you'll never beat a council ticket by claiming it's "too expensive", you need to show a process or legal flaw in the issuing of the ticket.

Very worth appealing ( I got one from B&H in similar circumstances a few years ago and won ). Many councils issue their tickets incorrectly with either processes not having been followed or TROs not being in place. You should go to Pepipoo and start a new thread posting up copies of the ticket ( back and front ) with any identifying marks taken off. Pepipoo have around a 75% success rate I believe.

Parking at Asda is free for three hours. Parking in the multi storey car park is free for four hours. Automatic number plate recognition cameras operate on entry and exit to check on time spent in the car parks. I had an issue around a month ago with a mechanical problem with my car. The issue was resolved but took nearly four hours, I then received an invoice for going over the agreed time limit. I emailed the parking company to inform them that I would be asking Asda to overturn the ticket as this was an issue beyond my control. Head office informed me to go to the store at the Marina and speak to the customer service manager. Garry who dealt with my issue was very understanding and took away my ticket/invoice and cancelled it. The car park is managed on behalf of Asda and they can and will cancel tickets. If you do have an issue in future and need to keep your car for longer than the allotted time, customer service in Asda can issue an all day pass.

( Not sure going bowling, to the cinema or eating out constitutes a reasonable excuse :whistle: ).

This , especially if you're a regular customer who spends roughly six grand a year in their store.
 


I have ignored these in the past, appealing, complaining or whatever is entering into a contract with them, as soon as you do that you are on the way to accepting liability, it is an idle threat of court action, (they use the term 'MAY result in county court judgements blah de blah....). stick any correspondence in the Vera Lynn, I've ignored several over the years inc one from The Asda car park in question.

The signage wasn't clear, I paid and displayed but parked in a residents spot unknowingly. The adjudicator visited the site and agreed with me. She even recommended the council change the signage. Guess what ? Over six years later the signs are still the same. That's hardly weaseling out of pay for a ticket. The council are incompetent and only care about making money.
