Preston Park to Withdean Right of Way

This is mainly for those of you who walk from Preston Park Station to Withdean, but also for any of you DIY lawyers.

Today, once again, we again had a couple of stewards outside the station trying to stop us walking from Preston Park to the ground via the rough track by the railway.

Obviously we ignored them and carried on using this public thoroughfare but they told us that they were only doing their jobs (love that attitude) because the locals had complained about fans using this path.

I've had this before and had the most officious "Special" WPC ordering me to take the huge detour via London Road - thus missing kick off. Trying to have a rational discussion with her about what right she had to forbid us using this public footpath was a complete waste of breath. Indeed reciting nursery rhymes would have quite a challenge with this particular c0ntstable.

Nobody has ever tried to stop us using the same path on the way BACK from the game. Either the locals only object to us walking in one direction or the jobsworths are in a rush to fk off home. Perhaps WPC Upherownarse doesnt get such a kick out of making us late home as she does at the prospect of us running to avoid missing kick off.

Can anyone tell me what right stewards or the police have to refuse me access up this or any other public footpath?
What byelaws would have to be in place?
How many locals would have to complain to get a footpath closed?

If they try this again, I want to have a row with them, but I don't want to miss the game and need to confirm that they have no right at all and I am on solid ground

Calling them jumped up jobsworth tossers is probably not the best course of action, tempting and accurate though it is.

I thought it was part of the planning permission for Withdean that fans didn't use it.

Exactly.

So i don't understand how fans have been able to leave the ground that way for the last 5 or so seasons!

You can leave that way but not go to the match that way.

Hang on. The greatest concentration of people will be leaving after the game. Before the game the stream will be less constant. Therefore why is there a problem with people going that way before the game? If residents are concerned about the noise or mess then surely stop people walking that way in their hundreds after games.

We don't know that yet. Have any residents who lived there actually complained? Or is this wanky council making it up as they go along again :censored:

You mean the council who are right behind us and gave us permission 11 to 1 for Falmer stadium?

As a local resident anyone trying to stop me walking along the continuation of Station Road will get a slap !!!!

It is indeed one of the elements of the planning agreement with the City Council that allows the Club to use Withdean.

Nothing will happen to any individual who chooses to ignore the restriction. You are "within your rights to do so".

The worst that could happen is that enforcement action is taken against the Club, who could be evicted from Withdean and go out of business.

So ... carry on, Mr Hazgon.

A site that links to Brighton and Hove Council recommends that track 'a walk' if I popped down there now I don't expect anyone would stop me just tell the Stewards you are going on a nature walk in Albion gear irrespective of The Albion playing or not.

Well what a crock of shit this has turned out to be !

I've been using this path for five years and always walked past the signs which I have been told by stewards/police in the past referred to vehicles not pedestrians and on another occasion because it was so muddy. Never once have they said its anything to do with the council's restrictions on the club using Withdean.

Nothing has ever been mentioned in the leaflet "getting to withdean" forbidding me to use this path, as far as I can remember.

As an earlier contribution mentions, people trickle through there on the way to the game, but loads come through together on the way back. What can possibly be the justification for allowing people to use the path in one direction and not the other.

If the council could explain the justification for this I would love to hear it.

In the meantime, I'll give the pub a miss pre match. I will not walk miles out of my way.

I'm sure it has, it's called Snakey Lane and has always been part of the restrictions for the use of Withdean. Can't we all try to keep the locals happy, a little exercise will probably do you good.

why dont you just leave a bit earlier, then you can go to the pub as well. Its not really miles from Preston Park station to Withdean either. If you're really lazy you could even get the bus
