Park & Ride - Boxing Day Reversing Accident

I asked this on Boxing Day, but did anyone see what happened when a Shoreham 414141 Taxi drove into my Alfa 147 on Boxing day?

The Taxi driver is now claiming that I drove into him, so he cannot accept liability (even though he was reversing out into me).

Please, if anyone saw this, please let me know!

I was just trying to see if there were any other witnesses to this accident.

Can you blame me? This taxi driver is claiming I drove into him! (even though I was on the main part of the park and ride)

Sounds pretty clear-cut then. If the damage is on your drivers door, how can he POSSIBLY claim it was you who drove into him ?

Well, he claims that I moved into the space (on the main road) that he was reversing into, strange - as I had my handbrake on at the time, as the bus was infront of me.

He also says he has a witness who said I could have gone forward, which I don't believe...

Not so clear cut.

I had a white van hit the back of my car with the side of his van. He was undertaking me as I was turning left in a car park. I had to break (due to a woman sitting in the middle of two lanes). Thus the side of his van scraped along the back of my car.

Naturally he claimed I reversed into him. Ended up 50/50 and I lost my no claims bonus.

BASTARD.

If you come alongside someone, it is possible for the first impact to be your drivers door against one of his corners - but at worst it would be knock-for-knock, i.e. both of you with some degree of culpability - and the insurance companies can't be bothered to pursue the details, because it's a waste of their time and money.

Well thats bollocks - if thats the basis of his "non liablilty" claim, he hasn't got a leg to stand on. You can't claim that someone "moved into the space I was reversing into". What is it, his road or something ? If you were on the main road, YOU had right of way and HE should have waited.

Oh by the way if you do enter into a counter calim situation and there are no witnesses you are virtually guarenteed 50/50 and the 'legal' team will do sweet FA to actaully prove anything.

What will happen is they will send letters to each other saying

"You did it"
"no we didn't you did"
"no we didn't you did"
"no we didn't you did"
"no we didn't you did"
"Will you accept 50/50?"
"no"
"you did it"
"no we didn't you did"
"no we didn't you did"
"no we didn't you did"
"no we didn't you did"

This goes on for about 9 months. They will end up by asking if you want to take it to court. You would then be liable for costs if you lose.

I fecking hate 414141. I saw it, and so did kevinsmith. ;)

Are you sure it was a Shoreham taxi (or private hire) as 414141 have B&H cars too? What car was he driving? Did you get his plate number?

I sympathise, I had a similar thing happen to me; there is nothing quite as sickening as seeing some numpty reversing into the side of your car; it all seems to happen in slow-motion.

I expect the insurance companies won't budge from 50-50 though.

In my case the insurance company wanted to write my car off, which was irritating as all I needed was a new door. Fortunately there administration was completely incompetant and a good session of complaining yielded £50 compensation, which was more than enough for me to purchase and fit a second hand door.

It had 414141 down the side, and 'private hire' only (or something like that) as well.

It said nothing about Shoreham (but the guy was from shoreham!)

There's no way this should end up in 50/50 territory.

Disgruntled was already on the main road, therefore he had right of way. Someone reversing out of a parking space into the side of Disgruntleds car....you can't get a more clear-cut case of liablity than that. Even if the cabbie thought Disgruntled was letting him out, it STILL wouldn't make any difference.

Insurnace companies love 50/50. They both win. They only pay half the costs and both parties lose their no claims bonus.

The only thing in it for you is that you only get to pay half your excess. As mine was only £100 at the time it wasn't much consolation as my premium went up by more than that!

The problem is that my excess is £250, and the cost of the claim in a £320 fix... If it's 50/50, even though I have a protected NCB, it would cost me a lot of money
