Albion's Championship relegation rivals Rotherham have been charged with fielding an ineligible player against them.
The Football League have charged the Millers for using Farrend Rawson in their 1-0 victory over the Seagulls in South Yorkshire on Easter Monday.
The rule breach will be discussed by a Football Disciplinary Commission which the League says will "take place at the earliest possible opportunity to ensure that it reaches its conclusion before the end of the current season."
Albion were involved in a similar case in the 2009-10 season.
Hartlepool were deducted three points for fielding Gary Liddle against the Seagulls in their 2-0 win when he should have been starting a suspension.
Albion boss Gus Poyet protested they should have been awarded the points.
A three-point deduction would have serious consequences for promoted Rotherham's survival prospects.
They are currently a place and seven points above the relegation zone and two points adrift of Albion.
