[Help] O/T Advice needed speeding summons

Firstly it wasn't me. Secondly, yes they were stupid.

Right, a relative of mine has been summonsed for doing 106 on the A27 at Hangleton.
There is no specific location on the summons other than A27 at Hangleton and you can't make it out from the photo but we assume it is eastbound going down from Dyke Road to Hangleton Bottom (Toads Hole).

We assume it was there as the car in question wouldn't do 106 without falling to bits but might get up to 80/90 down that long hill.

Does anyone have any advice? Yes they were no doubt doing more than 70 but 106

? never.

Do the Police have to provide a more specific location? They haven't even said what direction lol.

Is there a good way to plead guilty to speeding but dispute the speed? So she gets a fine but not a ban?

If I thought she had been doing 106 I wouldn't be trying to help her. Especially as she had kids in the car at the time.

She will probably plead by post as she would go to pieces in Court so if anyone has a good form of words to use that would be great.

I'm no expert but surely most cars could reach that speed if there less than 30 years old ? i had a fiat 500 loaner for two weeks and got a ton out of that with a bit to spare i reckon .

I got my all time record speed on my moped (Honda SS50) down there - 45 mph. But it was steeper in those days.

I’ve got a purgeot 206 and I feel like a slight kick and it’ll all fall apart. But it can get to speeds like that even as a 1 litre engine. I’d suggest the speed maybe correct and question your friends integrity.

You can't plead guilty if you are disputing it.
Given a ban + heavy fine is likely I'd recommend taking legal advice on this from someone that specialises in speeding offences. They'll likely be able to request certifications of tuning of the equipment that caught them to know it had been tested and working fine as part of the court process.

Note - appealing it but still being found guilty will be even worse than accepting it. With a good solicitor it is possible to avoid a ban, my mate got caught 99mph in a 60mph but with a job with country wide travel + a child on the way and some good references he managed to avoid a ban, get 6 points + a heavy (£xxxx) fine

My old 04 plate fiesta could reach over 100 so it's not a impossibility that the speed stated is correct, sorry to be the bad news bear.

If it is eastbound then that is going up the hill? I would have thought the summons would state exactly where and when. Police do sit up on the bridge near the dyke road bit and also have been on the layby when you go down from Dyke road and a going up the small rise after hangleton.

There is a precedent for this offence.

The outcome is to get a ban, but console yourself with a lucrative, move to West London, and to continue to drive anyway, whilst banned.

The charge is more than likely driving in excess of the speed limit, not driving at 106.

So they could plead guilty but dispute the 106.

However that would be a case of disputing the accuracy of the recording instrument. If they succeeded in that then it would be difficult to gain a conviction.

I would suggest professional legal advice, and if it was me I would pop into one of the solicitor's offices opposite the Magistrates Court in Edward Street, as they deal with these situations on a daily basis.

I thought that for over 100mph you must attend court and being over by so much will also end up with a disqualification [unless in exceptional circumstances]

Advice to relative:
Elope to Europe while you still have your liberty ...
or, if you can't do the time, don't do the crime ...

I got picked up speeding on the M23 in an MR2, when they first came out. Officer at the time said I was doing 96, summons came in post and said I was doing 102. I contested this and got the speed reduced in court to the 96 I was told at the time I was stopped.

Mind you I got a **** off fine and the pleasure of spending the morning with extras from Jeremy Kyle.
