So this herbert calls in sick, then later that day gets clocked by a duty manager drinking outside a social club, claimed he was in bed ill all day but "only went down there for 15 minutes", gets the tin tack - but then wins his claim for unfair dismissal because there's nothing in his contract that states he can't go out pubbing when he's called in sick. AND he's in line to receive compensation from his previous employers.

Stop the planet please. I want to get off.

The company clearly made a hash of the disciplinary procedure, but its irking that this malingerer exploited it to the full and will likely profit from it when the tribunal reconvenes to thrash out his 'compensayshun'.

I bet they've sharpened up their sickies policy for everyone else now.

The company clearly made a hash of the disciplinary procedure, but its irking that this malingerer exploited it to the full and will likely profit from it when the tribunal reconvenes to thrash out his 'compensayshun'.

I bet they've sharpened up their sickies policy for everyone else now.

He's got COPD, he's not a malingerer.

Pretty sure this was more to do with the shoddy investigation the employers undertook. Disciplinary procdedures were breached apparently. This day and age they must be followed to the letter I'm afraid.

I'm sorry, but unless it's gross misconduct (which to me, this isn't), you can't just arbitrarily sack someone for something like this. All employers should have due process to follow and may well have ended with a watertight termination. I have no problems at all with him winning this case.

Indeed. He's got off the hook because their procedures were inadequate, and he exploited it (and them) to the full. There'll have been some internal arse-kicking at that company after the way this has turned out.

Being off sick doesn't necessarily mean being confined to bed or even your own home.

Agreed.

But the pub is a bit much isn't it ? I'd be far too paranoid at getting clocked there by a workmate. A Pot Noodle and a few tinnies in front of Netflix would normally suffice, shirley.
