which society are you referring to....??? the independent is usually quite impartial/neutral......have a reader the article , there are enough fruit loops in Britain as it is , we don't need be importing them unnecessarily ......imo

And possibly rightly so, when a Brit who went to fight against Isis is possibly facing charges relating to terrorism! No, I have not got a link but was just shown on BBC One O'Clock news.

There's a great article by the Secret Barrister where he/she points out that it's absolutely right and proper that Begum is granted legal aid. It goes into lots of detail but the closing paragraph is well worth quoting

"So when the Mail invites its readers to fulminate and howl and ask Why should the public pay for this awful woman’s legal aid?, the answer that should be given – by our Lord Chancellor, preferably, as the person with the statutory obligation to uphold the rule of law – is because that is the price of living under the rule of law. If you’d rather exist in a society where the rules are not applied equally, where your entitlement to a fair trial is dependent on the whims of government officials or the roar of the effigy-burning mob or the deepness of your pockets, there are plenty of countries out there willing to oblige."

This puts the rationale extremely well.

In our society everyone regardless of the nature of their crimes is entitled to a fair trial, and where they have insufficient funds, they should be provided with legal aid.

The wider question is what effect has the clawing back on legal aid by the Tories had on our society and are people accepting guilty verdicts as they are refused legal aid, and have insufficient funds themselves to robustly defend the charges against them.

Not a mail reader, but perhaps then the law should change so that those who choose to go and fight against our country are automatically disallowed from aid.

Isn’t there a bit of a flaw in your suggestion? In order for you to apply your disqualification, you are effectively finding them guilty BEFORE they’ve been tried, or had the opportunity to contest those charges :shrug:

You are right. It just seems to go against the grain and natural justice. She went off to war against our country. She is a traitor in my view.
