Cheesefest - where's our refund?

Hi chaps,

Just after a little bit of advice on behalf of Shingle Jr.

Last Saturday, as some of you might know, there was a cheese festival in Brighton.

Shingle Jr paid £6 per ticket in advance. He paid for three tickets.

The event was a shambles the queues an hour long. His friends who arrived 10 mins after were turned away on account of the venue selling out of food. Shingle Jr and friends ate nothing and drank nothing. They went to one of the organisers who told them to email in and they would be issued a refund.

Three e-mails later they have heard nothing back. Shingle Jr has posted on their Facebook wall and some comments have been deleted (although some remain).

He know's its only £18, but he's digging his heels in over the principle.

OK chaps, what recourse does he have at this stage or should he just cut his losses?

I felt the same when I went to the Cheddar Gorge.... it was awful, all rocks and vegetation, not a sign of trestle tables loaded with cheesy comestibles.

If he hasn't received what he bought then his most likely legal recourse is for damages for breach of contract. That's a civil action. He could use the small claims court - if he won, he'd get his costs back too. Of course, merely a threat of going to the small claims court may persuade the organisers to issue the refund.

His hourly rate for filling in all the forms isn't that high though...he may be better off finding another way to earn £6 (or £18 if the two others haven't stumped up their cash)...!

The bunch of shysters will undoubtedly find a way to hang on to their money; it's probably in the small print somewhere. A bit like those of us who forked out £45 to watch the pre-season friendlies - we'll likely never see our money again. He's lucky it's 'only'£18. Best thing is to move on, recognise there are some dishonest shysters around who are always after our money, and regard it as their right to keep it whether they provide the service paid for or not. Just need to make sure that particular bunch never get anything else from him, ever again.
