"“We have considered files of evidence from 14 police forces in respect of allegations relating to Conservative Party candidates’ expenditure during the 2015 General Election campaign.

“We considered whether candidates and election agents working in constituencies that were visited by the Party’s ‘Battle Bus’ may have committed a criminal offence by not declaring related expenditure on their local returns. Instead, as the Electoral Commission found in its report, these costs were recorded as national expenditure by the Party.

“We reviewed the files in accordance with the Code for Crown Prosecutors and have concluded the tests in the Code are not met and no criminal charges have been authorised."

Was never really coming to anything through the CPS - ''It is an offence to knowingly make a false declaration. In order to bring a charge, it must be proved that a suspect knew the return was inaccurate and acted dishonestly in signing the declaration. Although there is evidence to suggest the returns may have been inaccurate, there is insufficient evidence to prove to the criminal standard that any candidate or agent was dishonest.''

So they inaccurately reported the spending because they were told by Party headquaters that the buses were part of national spend.

So who here is at fault, CPS wise? The individual that told them?

More likely the CPS just pandering to their political masters.

and the Electoral Commission? they reported that the cost in question where recorded as national expenses.

what the whole issue seems to be down to is whether or not the local agent entered a line "battle bus (national expense)" or not. if they didnt, they may have filed an "inaccurate" declaration. as they where told this expense was covered nationally, they may not have recognised it should be recorded in the local declaration, so did not omit it dishonestly. therefore no offense, or insufficient evidence that they acted dishonestly.

The Tories are accused of attempting invoke Article 50 illegally, there's a court case that backs this claim and everyone cheers the legal authorities for following due process - democracy is saved.

The Tories are accused of illegal election spending, there's an investigation and the legal authorities determine there is no case to answer. I wonder if those that cheered the legal process in my above example will be as enthusiastic in their support of the same authorities in this case ?
