Why do these cases now get heard at The O/B rather than a district court ?

The Old Bailey tends to take cases from outside London that are deemed to be the most serious of crimes, and those that are the highest profile and of the greatest national interest.

Seems a horrible man that killed someone due to political views that opposed his own. Deserves the whole life sentence.

He's a coward, who attacked and killed a 5' 0" defenceless woman, for her beliefs, but couldn't even give an account of his actions in court.

Mair was tried as a terrorist, which is one reason why the trial was at the Old Bailey. His defence didn't offer any medical evidence in mitigation.

No he wasn't. The police said they explicitly didn't try him as a terrorist as murder is murder and the ideology aspect would muddy things.

Following the verdicts, Richard Whittam QC, prosecuting, told the court that Mair had committed a terrorism offence when he murdered Cox, but added that it had not been necessary to prosecute him as a terrorist.

There were two reasons for this. Mair was charged with murder, which is a crime under common law and not an offence under counter-terrorism legislation; and the jury was only to be asked to decide whether or not Mair had committed the crime of murder. It was not asked to consider his motivation.

Prosecutors acknowledge privately that the febrile atmosphere in which the EU referendum campaign was waged appears certain to have contributed to Mair’s decision to murder his MP, but this played no part in their case. There was no need to refer to the referendum in order to establish his guilt.

The police charge a criminal. The CPS prosecute, and the court try the case.

The answer is that Mair was indeed prosecuted as a terrorist, and this was made clear during preliminary hearings. This is the reason that he was tried in London, rather than Yorkshire.

But he was charged with murder, a common-law offence, rather than with an offence under counter-terrorism legislation.

Crown prosecutors did not use the word “terrorism” during the trial because they believed the jurors should be asked simply whether they believed he committed the crime or not, rather than also be expected to consider his motives. The killers of Lee Rigby were prosecuted in the same way.

During the trial, the crown did tell the jury that its case was that the murder was politically or ideologically motivated.

Following the guilty verdict, this allowed the judge to sentence Mair as a murderer who is also a terrorist.

Immediately after the case, the Crown Prosecution Service said that Mair had been convicted “of the terrorist murder of Jo Cox”.

Sue Hemming, head of special crime and counter-terrorism at the Crown Prosecution Service, added: “Mair has offered no explanation for his actions, but the prosecution was able to demonstrate that, motivated by hate, his premeditated crimes were nothing less than acts of terrorism designed to advance his twisted ideology.”
