Without wishing to pre-judge the Spanish judicial system, I'm going to go out on a limb, and guess that he will NOT go to jail.

If it starts to look even slightly iffy I suggest he may find himself back in Argentina and demanding a transfer. I'm sure Carlos Tevez can give him some good advice on how to get a transfer.
