when he joined he signed for 3 years
It has already. He offered his resignation; the club accepted his resignation. The contract ended at that point. He originally signed for 3 years.

Nope. As soon as the club have decided who they want to appoint, there are no legal restrictions from our perspective that would stop them doing it immediately. Of course, there may be restrictions that are due to outstanding contractual obligations that the new manager may have.
