Should Wigan Athletic receive points deduction or a fine?

Wigan have been fined £40,000 for breaching the Football Assocation's Football Agents Regulations regarding the signing of Marc-Antoine Fortune.
The charge related to agency activity carried out by Willie McKay for the Championship club in relation to the capture of the striker in July 2013.
Both Wigan and McKay admitted breaking regulation C10(a)(i) at an Independent Regulatory Commission hearing.
Fortune, 32, has played 48 times for the Latics, scoring five goals.
McKay has been warned over his future conduct and had his overseas agent registration suspended for nine months. The suspension is suspended for two years.
The sanctions are subject to appeal.
Wigan, who secured a place in the Championship play-offs with a 1-0 win at Birmingham on Tuesday, said they were "awaiting the full findings of the Independent Regulatory Commission to enable us to review our position in respect of the decision".

Too late for point at this stage of the season. Even if it was the FL preferred option it wouldn't be used.

Between their own administrative delays and the legal challenge it would cause, any full and final deduction would be too late to impact this season and there is a possibility that they are out of FL control next season.

Someone has sat in a room and decided that points loss could/would land them looking very stupid or ineffectual, so fine it has to be. Wouldn't be surprised if this has already been agreed with the club to avoid a legal challenge... some form of plea bargain.

Same old story though isn't it, AFC Wimbledon do it and get a fine and three point deduction, Sunderland and West Ham do it and get a fine :censored:

I reckon an 8 point deduction is the correct procedure.

As per usual the FA take the easy option and issue a fine. Wigan have the right to appeal the decision but with no points deduction hanging in the balance it doesn't really matter which way the decision falls. Small clubs like AFC Wimbledon and Alfreton Town are penalised with a 3 points deduction for fielding an ineligible player. Double standards or what ?
