This has just been published on the Argus site, thought some people may want to see it.

The League Managers Association has leapt to the defence of suspended Albion manager Gus Poyet after he avoided the club's disciplinary hearing at The Amex this morning.


In a strongly worded statement, released on their website, the LMA said: "Brighton & Hove Albion FC ordered Gus Poyet to attend a crucial disciplinary hearing today, despite the fact that he only returned from annual leave yesterday and the charges were not particularised until 13th June.


"Further, the very lengthy appendices to the initial report comprise around 500 pages and these were also only delivered recently. Clearly Gus needs to have a fair and reasonable opportunity to respond to what we believe are unfounded charges against him.




"Also, it has repeatedly been made clear to the club that Gus’s LMA representative, Richard Bevan was not available to accompany him today, but was available to attend on Thursday 20th or Friday 21st June as well.


"These two dates fall within the five working day period for an employee to offer alternatives to the original date set by the club as set-out in the club’s own handbook.


"We believe that our members are entitled to the same legal protections that other employees enjoy. Football clubs need to observe basic employment rights like any other employer in our view. Just to be clear, however, we are confident that Gus will demonstrate there is no case to answer in this matter.



"Notwithstanding these important points, the club decided to go-ahead with the hearing in the absence of both Gus and Richard Bevan.


"Late this afternoon the club agreed to adjourn and reconvene the disciplinary hearing to Thursday 20th June 2013. The LMA is pleased that the club has agreed to an arrangement whereby Gus and his chosen representative will be able to attend."

We really should not have let him go abroad without sorting this out beforehand. It's come back to bite us as he's using it as a delaying technique.

So bearing on mind he has had three overseas trips whilst under suspension, and a month to prepare his case, if he had one, don't you think most right minded individuals would have flexed a little bit and made himself available at the earliest rather than the latest opportunity.

Especially I think as Gus would know full well that even if he stayed, there should be player recruitment activities taking place right now.

It's employment law, if he wasn't contactable and was on holiday, nothing can happen until contact is made. He will be entitled to LMA representation and meeting will not go ahead if LMA representation is not available of which I assume GP is a member of

Exactly. He had a kick about and spent his time on TV when he could have been spending time saving his job if it meant enough to him.

500 pages - there must be A LOT of things he's accused of doing wrong!!

If indeed it proves there is no case to answer and Gus is cleared by his legal team, where an earth does this leave us ?

Barber to stand down ? Or can we still get rid of Gus but pay him the remainder of his contract ? Whatever the outcome surely he can't ever return as manager now ??

It's his legal team that will do all the stress side of things, that's what he'll be paying them to do.

But this all happened before he went away... It's common for contracts to state that the annual leave is at the employers discretion. It's also known for employers to use this right to cancel annual leave in times like these.

The club should have held firm before his annual leave started. Now we have played into his hands and he knows it.

L.M.A defending member shocker. It's just one side accusing the other of unfair or inappropriate behaviour and us fans feeling dazed and confused in the middle getting caught in the cross fire.

Why, the have produced the docs to support their case, with 500 pages in support.......tin pot would have been on the back of a fag packet.........its called doing a thou rough job.

Seems very silly to begin a hearing fully aware that the subject of that hearing isn't even there.

Almost seems the meeting was started just to claim Gus didn't attend it.....

Suspended on full pay pending further investigation, when was the investigation completed to invite to a hearing?
