A player can tackle another player then stamp on him in front of the referee and the TV camera's and get away with it and another player can be accused of something that he has been to a court for and found not guilty and the good old FA can fine him and ban him.

Your right about that but don't forget that sideshow bob let the ball run and changed direction in order to barge Aguero in the same incident, comes off worse then grabs the ball. he should've picked up a booking .

Presumably the challenge was seen by the referee? In that case the rules are clear that retrospective action cannot be taken.
