Are you really suggesting that the website would not have accurate quotes from the court room?

No, I haven't. The night porter stated in Court that he had heard the sounds of people having sex – when pushed on this he said that he had heard both female and male voices “squealing, panting and groaning”. He also said that he heard a male voice ask for oral sex in a “playful” manner...

The night porter said he had heard both male and female voices and groans as well as a request for oral sex. Admittedly that was with McDonald, who the jury agreed had gained consent. That is further evidence that she was conscious and able to give consent/deny consent. I'm still yet to hear...

Have you ever been drunk? If you are able to walk, stumbling or not, into a hotel you're able to approve or disapprove to having sex. She was in heels too was she not?

They both said that, to some variation, yes. The whole jury felt we had to be certain as we discussed it when coming up with a verdict. So me mis understanding (quite likely as I quite literally get bashed in the head for a living) can be ruled out. I had two trials over the 2 weeks I was...

Sorry no, the word used was "certain" I had meant to type that (been a busy morning!) We was told we had to be certain to reach a guilty verdict.

Surely not? McDonald was just visiting Ched's home town for the night (hence the hotel) I would be very surprised if he knew her too.

It's what I was told when I done jury service a couple of years back. Something like "If you are sure that this man committed the crime, your verdict will be guilty. If you are anything other that sure, your verdict will be innocent"

Okay, but if, for an unknown reason, she complained of rape and the jury believe she was too drunk, you could then be convicted of rape, despite at the time you fully believing you're doing nothing wrong? So would in affect, be accidental rape - which seems odd. I'm really struggling to see...

Of course I have read the evidence. The girl has claimed that she does not remember anything. Ched however does remember, and claims consent was given. To which he has a witness. Which leads me to my original question. If a drunk girl gives you consent, but does not remember, is that rape?

I would think that is slightly obvious. But for arguments sake, lets say, upon waking you realise that you have had sex, but do not remember the events. Despite also being drunk, they do remember. That means rape? I might well of missed something about this case, so correct me if i'm wrong. But...

Really? So by that basis, if you have a night out consume plenty of alcohol, wake up in bed with someone and have no memory of going there, they have raped you?

What exactly is meant be "giving consent"? Does someone have to ask and have a verbal response of "Yes, you can"? If so, I would bet over 50% of this posters on this thread are guilty of the same thing.

I'm assuming that there is no Blackpool ST holders against him signing for someone? Seeing as their chairman was convicted and jailed for rape too.
