Of course they would but do you think OG would select them to play? - If OG didn't put them in the squad would you then claim they had refused to play? - To do so would be just as ridiculous as claiming that LB has refused to play - he hasn't, OG did not select him!
It is the club who are not asking LB to play, not the other way around, so it is perfectly reasonable that the club has to honour its contract and pay LB's wages.

I'm sure that if LB doesn't leave during this window then he will play as well as he possibly can for the rest of the season - the problem is that, as you have pointed out, if he is 'distracted' then his best could well be of a lower standard than previously.

But there is no suggestion he didn't turn up for work, (or chose not to play) - he wasn't selected - OG could have selected him to play if he'd wanted to.

I doubt that LB has been paid in total, over the 3 odd years he has been with us, the amount the club was offered by Sunderland - in essence he hasn't cost us a penny and we've had the benefit of his skills during that period.
