    If they didn't there would be a real problem because currently the EPL is contracted to accept promotions from the Championship and the League is contracted to accept relegations from the EPL. I can't see the EPL accepting a breach of that contract without at least a legal challenge and...

    Not really a matter of 'sticking two fingers up' at anyone - if the club simply hasn't got the money, which it certainly wouldn't have having run up huge losses, then it can't pay a fine even if it wanted to. FFP is the ideal way to drive clubs into administration.

    I'm sure you are right and in any case the club chairmen would never vote for such a proposal - as such I accept it is a non-starter. Doesn't mean mind you that the current FFP system is by any means FAIR.

    So do many financial companies but the directors can be penalised as individuals by the FSA - simply requires appropriate legislation. What would happen if for example Bolton were promoted to the EPL and a fine imposed on them by the League but the club were simply unable to pay it?

    Not a matter of having it both ways for many of those affected by the success or failure of a club. Suppliers for example will have invested in order to provide the necessary goods or services during the 'years of plenty' then along comes the league and penalises the clubs reducing demand...

    Why should the clubs, (staff, players, suppliers, fans, transport companies, sponsors etc), be 'punished' rather than the individuals, (i.e. the shareholders), responsible for the breaches in the first place?

    Hardly! Would it be OK for there to be a mandatory clause, (irrespective of the employer's or employee's wishes), governing the future wages or employment status of accountants, bricklayers, teachers etc.

    A mandatory clause such as you propose would also no doubt breach various employment laws across Europe.

    Sanction any club for breaching the rules and there will almost certainly be grounds for a legal challenge based on the application of the rules. How can FFP include the word "FAIR" when a club can play in a modern stadium rent free simply because the owner of the stadium happens to also own...
