It's not really a right or wrong though is it? It's more of a "what would you do?" type of thing, and i said what I'd do.

I fairly regularly issue fines out at work (which i REALLY don't like doing but often have no choice) and you'll be amazed how many people seem to think that i/others don't have any right to, just because they don't agree with it.

Don't know what you do for a job but legally the only bodies permitted to issue FINES are councils, HMRC, the police and the courts. If you aren't from one of these bodies or their approved contractors then you have no legal right to issue a fine.

In summery I do agree it is wasted energy but... this was not a private company but a local council. Surely in times like this they should not be selling on a debt to these hounds.

Luckily for me, I dont feel overly worried by his bully boy tactics and am fortunately in a position where I can pay the money if I have to, but I'm sure they apply the same forceful tactics on people who really are on hard times at the moment and behavior like this could be enough to push someone over the edge.

Also do you think 1 text message from a completely unknown company with no details on why they are demanding money is reasonable? If they are going to send demands like this which escalate in cost so rapidly they should at a minimum tell you why they are contacting you in the first place, when generally the advice is do not give out your bank or card details. It seems as if its set up for people to fail so the cost is pushed up very quickly.

Have you considered this might be a scam?

Next time they ring you ask for correspondence validating the claim and evidence of the parking breach to your email address (create a separate one)

You only need to take notice if you actually start getting County Court notices from Northampton warning of an issue of a CCJ. At this stage they are just trying to put the frighteners on you. Hold your nerve and they may well just forget about it as not cost effective to pursue.

This is not the right advice, since the Beavis case in 2015, which established in the Supreme Court that private parking tickets can be legal.

Sigh ..... ALL private tickets can be cancelled or thrown out of court IF you follow the correct process. I'm sure [MENTION=18265]LadySeagull[/MENTION] can give you more details.

I've never failed to get one cancelled out of the hundreds I've fought.

From what the thug on the phone tells me it is now court issued and has gone to far to fight, only option is to pay or cost will keep escalating.

It seems set up for you to fail as what chance do you have if they don't even contact you at your current address, seems like an easy way of bumping up a debt to make to it worth chasing. I'm sure most people are intimidated by people like this and just pay up very quickly.

How come you have been issued “hundreds” of tickets? That must take some effort? Do you actively go looking for them?

I didn't say my own did I ? But yes, I may have got a couple of G24 tickets on purpose though.

Thank you everyone so far, I've seen no paperwork at all. I've only had the text from CDER who I assume have brought the debt from the council. The bully on the phone has now called me 8 times in 2 days and has also started texting and said if no payment is made today the cost will go up again.

They may have issued paperwork but non has come to my current address which he did confirm but on the phone, not in writing.

Not sure what my options are to fight it without the cost going up.

Genuinely, I wonder how they found out your mobile number. Do DVLA release it to commercial third parties (that’s assuming they had it in the first place)?

I can only assume from the current owner of our old house who we left forwarding details with at the time of the move.

I'm not going to comment on the right or wrong and this is not legal advice, but I'd be inclined to stump up, suck it up and pay up and move on with your life. Far too many people get tunnel vision due to a sense of injustice and want to do all in their power to fight these things so they don't feel they've 'lost'.

It's not really about right or wrong, because you've already admitted that you probably did get the parking ticket (although i don't agree with these private parking fines).

I find it best to apply the reasonable person test. I.e if a reasonable completely unbiased personlistened to both sides of the story, baring in mind the company wrote to you at your old address, sent a message to your phone (which you've admitted you read), would they feel that the parking company have done enough, or would they think you have a good reason not to pay?

Good luck anyway, these private parking fines companies piss me right off. But in summary, lifes too short. Pay it and move on with your life.

Do not pay until they have given you paperwork that you have validated with the council or applicable municipal authority.. Sounds like they are a bunch of cowboy debt collectors trying it on.

Cost can't escalate post court as it is set in court what the award is. Load of tosh

Secondly really don't listen to the pussies on here saying pay it. They are even too wealthy to care or dumb arse.

Why didn't the current owner of your old house forward any mail relating to this to your new address? That's off course if they received any.

It doesn't hold water anyway.

If you want to scam people all you would have to do is find people who have recently moved, issue a small court claim against them for services (whatever) issue it to their old address, await the no response and the court will find in your favour then pursue them at their new address. Easy money if your [MENTION=1517]junior[/MENTION].

This - but by post. They really can't expect to threaten court action just by phone calls and texts?? There has to be something in writing surely?
