I kind of know the answer to this and am asking more in hope than expectation...

Yesterday evening I made the mistake of parking in parking space which was 'residents only 6pm - 8am', when visiting my brother on Ilkley.
I arrived at 6:30pm and thought brilliant and parked. Basically I misread the sign and thought it was restrictions during the daytime. My mistake, I should have read the sign properly... The fine is £70, but halved if payment is made within 14 days.

The ticket has my registration number on it, but in the description it says Citroen, colour silver. My car is a Renault Clio in silver. Where do I stand challenging the fine based on the incorrect filling in of the ticket... I know it's only £35, but thats half a tank of petrol / a few beers!

Any advice would be appreciated!

Probably not a lot you can do if they have the correct registration plate I would have thought.

I have only ever recevied one parking ticket, but I got it overtuned because they got the street name wrong! Happy days.

Invalid ticket then, no problems. Just write in to the appeal address and explain the mistake on the ticket and they can't enforce it. They'll check the pictures taken of your car (you can do that too, if you go online to the Brighton and Hove Council website you can view pictures of your ticket) and see the mistake.

Can you tell me the attendant number? I may know them and be able to text some competance based abuse.

Hi, it was up in Ilkley, West Yorkshire.

I presume the same applies to all council tickets, if they get a fairly basic detail wrong the fine is not enforceable?

Yes, should apply everywhere. Anything basic like the make and colour are required. There were people in Brighton and Hove who would always put unknown make and unknown colour, just to avoid it being incorrect.

I'll give it a go and if I get off I'll donate it to a worthy cause...

If I don't, I'll go and get my eyes tested and learn to read basic signposts in the future!!

Sorry, I'm going to disagree. Incorrect make, model or colour are not essential, and the ticket is not invalidated by getting this bit wrong.

Your best bet is to go to PePiPoo: Helping the motorist to get justice and post up your ticket on the Council Tickets forum and let them see if there are any other mistakes that would make the ticket invalid.

I am going to disagree with you because when I was doing the job, it was always clearly stated that get anything like that wrong and the ticket is invalid. I worked briefly in the parking shop too, and the same was true there.

I am going to disagree with you because when I was doing the job, it was always clearly stated that get anything like that wrong and the ticket is invalid. I worked briefly in the parking shop too, and the same was true there.

As a CEO, you will have been told that getting the colour, make, and model correct is important, because it backs up the fact that the correct vehicle was observed. It can be used as a defence if it is wildly incorrect, and you feel that your car was not correctly observed by the CEO, but it does NOT invalidate the ticket.

I specifically know of tickets cancelled due to incorrect make being put down on the ticket.

Quite possibly, but that would be discretionary on the part of the council. Wrong colour, make or model doesn't invalidate a ticket automatically. Halifax Seagull would be best off posting on Pepipoo and seeing if there are other flaws in the ticket or signs/markings.

I got two parking tickets within my first 12 months of passing my test. Thought I had reasonable grounds to appeal on the second ticket as there was a sticker covering the sign on one side of the road, and a tree blocking part of another sign nearby. It got rejected :(

A lot of councils do have a habit of rejecting claims regardless of how valid the claim is, however if you do have a strong claim, a lot of councils will back down but only when it gets to the independent adjudicator stage.

Not all councils have taken over parking enforcement and so you'll need to check first as the rules are slightly different. Either way, just getting the model of car incorrect doesn't automatically make it an invalid ticket.

Sound advice. Every time I've appealed against a parking ticket, with a reasonable explanation and something approaching an apology, I've received a nice letter back saying that "on this occasion" the penalty won't be enforced.

Other people's bad parking, not mine, btw.

I got a ticket two weeks ago because although I although I had scratched off the correct day and date on a visitors permit supplied by a customer I did not have a pen to write the registation in the box on the ticket. Went inside to get a pen and got into a conversation with the customer and came back out ten minutes later to fill the reg in on the permit and a ticket was on my windscreen. The permit was on the dash for the warden to see. Have appealed but I,ll be surprised if I get off. Strictly an invalid ticket but a bit harsh IMO.

That is an admission of guilt and if your letter is rejected you will have to pay the fine. My advice would be to ignore it until they write to you as the owner of the car then write to the council stating that you do not own a Citroen reg no ............ and then stick with it and insist on the matter being heard by a tribunal if they still maintain you should pay. You cannot possibly be responsible for a vehicle that you do not own and possibly does not exist. It could quite easily be a stolen car with false number plates how can you be expected to know.
