[Misc] What to do when injured in a road accident

A friend got knocked off their motorbike by a careless driver. He's ok. The police and ambulance came, the driver simply didn't see him at a roundabout. He has a slightly injured knee, torn ligaments in his shoulder, etc.

What should he do about getting compensation from the other driver's insurance company? Should he call one of those dodgy injury lawyers, or is their a better way forward?

He should get his own insurance company will deal with it although he’ll get bombarded from the world and his wife now.

Do it through his own insrance company. They will advise him. Also forces the other driver to admit liability quicker.

Always go to hospital for a check up. It helps with the claim. Certainly mine. To get a list of injuries

Depends on whether he has ULR cover on his own policy. If so he can pursue his claim via this, and recvoer his losses and obtain compensation for his pain and suffering.

One word of caution never accept the first offer from the third party insurers, particularly where there is an injury. This is because you are never sure how long th epain will last for and whether it will return in certain circumstances.

I am guessing their insurance company will have legal cover. Strangely I got knocked of my push bike, by a motorcyclist. Road his bike out of a side road straight in to my leg. Fractured pelvis and torn knee ligaments that required surgery to fix. Luckily for me I am a member of British Cycling and they provide legal assistance for these situations. Fortunately the motorcyclist admitted full responsibility, there was many witnesses so I don’t think he had much choice. This happened a year and a half ago and i am still waiting for any compensation, so your freind should be prepared for this. The reason for mine to take so long is that before the claim is made we must know how well the injury will heel and the long term effect. Once you settle you can’t go back for more if you find a new problem due to the accident, so the solicitor will make sure they know the full long term impact before they do that, or they should. It is not a quick process.

Er,no they don't all do that and increase premiums. I claimed two years ago and settled last year. No change to premium, so don't try and scare people off genuine claims!

I don't doubt your story, just suffice to say it doesn't make sense! Why would his insurance company put his premiums up when he has claimed against someone else's policy? Unless of course he is a serial claimer then they might consider him a liability ???
Also, why would he have lost his NCB as he hasn't made a claim against HIS insurance.

Then don't renew with that company then! Normally you only have to declare fault accidents when getting quotes.

All to do with the pointy heads, who look at the overall number of claims received and have deduced that if you make a claim you are more likely to make another claim than someone who hasn't made a claim.

I fully accept that you will no doubt say, I made a claim 10 years ago when some idiot went into my car and I haven't made a claim since, but the pointy heads look at the totality not the individual.

You are of course free to acceot the renewal invitation from your existing Insurers or move to another if the premium and terms are better

Go to a law firm who specialise in this. I used a legal expense insurer panel solicitor once and they weren't great. You get a personal service with a local specialist firm.

not sure on the laws in UK but presumably the driver was booked for neg driving/drive without due care & attention , this will open the way for all medical cost to the nhs to be reclaimed from drivers insurance company , it will also open the way for loss of earnings , pain and suffering , permanent or temporary disability claims against the unfortunate driver .......unfortunately it's dog eat dog with this sort of thing , squeaky wheel gets the old etc etc.
