It is possible that the prosecution failed to answer those questions, but it also possible that the judge failed to give the correct verdict.

Masipa has made several references to the fact he prayed to God and who he phoned after, it's almost like who he phoned after the event and the fact he prayed is getting him off.

Sentence-wise it's sounding like he'll get the lenient end of the stretch for manslaughter. It's up to the judge's discretion, and he has been found guilty re discharging the firearm in the restaurant. This feels like he should go down for 10 years, but I'd be surprised if he got 5 or more.
